Review of public assets
Implementing Directive No. 40/CT-TTg dated October 24, 2024 of the Prime Minister on strengthening the management of public assets at associations, recently, the People's Committee of Thanh Hoa province has issued a document directing departments, branches, unions, districts, towns, cities, and communes in the area on strengthening the management of public assets at associations.
Thanh Hoa Provincial People's Committee assigned the Department of Finance to preside over and coordinate with departments, branches, People's Committees of districts, towns, cities and related units to review the assignment, management, use and arrangement of public assets for associations under the local management. In case after review, it is discovered that the assignment, management and use of public assets are not in accordance with regulations, it must be reported to the competent authority for handling according to regulations.
Based on the plan for rearranging and handling houses and land established by the organizations, organize the inspection of the current status, synthesize and submit for approval the plan for rearranging and handling houses and land assigned to the associations within the scope of arrangement according to regulations. Guide, urge, promptly and fully update data on houses and land of the associations that are public assets into the National database on public assets.
The Department of Natural Resources and Environment shall preside over and coordinate with relevant departments, branches and units to review the management and use of land by associations under local management, ensuring compliance with the provisions of the 2024 Land Law.
For social organizations, socio-professional organizations, and other organizations established under the provisions of the law on associations: self-insure assets to serve operations; review, prepare declaration reports, propose plans to rearrange and handle houses and land for facilities that are public assets assigned to associations within the scope of arrangement.
Review the use of public assets of the association for business purposes, leasing, joint ventures, and associations, ensuring compliance with the provisions of law. Pay all proceeds from leasing and business to the State budget in cases of use that are not in accordance with the provisions of law on management and use of public assets; put an end to the situation of using houses and land that are not in accordance with regulations (leasing, lending, using for the wrong purpose, etc.), to ensure effective use, avoiding loss and waste.
Strictly handle
In addition to the review, the People's Committee of Thanh Hoa province also directed the inspection agencies of departments, branches and localities to conduct inspections and examinations of the management and use of public assets of organizations operating under the provisions of the law on associations under their management.
For organizations that violate the law on management and use of public assets at associations, depending on the nature and severity of the violation, they will be disciplined, administratively sanctioned or prosecuted for criminal liability, ensuring compliance with regulations and authority. In case of causing damage to the state, compensation must be paid according to the provisions of law.
In addition, strengthen the inspection and supervision of the management and use of public assets; inspect the rearrangement and handling of public assets of associations. Timely and strictly handle according to regulations associations under the management authority that violate the management and use of public assets.
Carry out house and land recovery in case of improper use of public property management and use regulations, land laws and other relevant laws.
