Point g, Clause 1, Article 34 of the Law on Road Traffic Order and Safety stipulates:
A motorcycle is a vehicle with two or three engine-powered wheels, designed and manufactured to operate on roads, with a design speed not exceeding 50 km/h; If the driven engine is a thermal engine, the working capacity or equivalent capacity is not greater than 50 cm3. If the driven engine is an electric motor, the power of the engine is not greater than 04 kW; motorcycles do not include electric bicycles.
Clause 4, Article 56 of the Law on Road Traffic Order and Safety stipulates the conditions for motorcyclists participating in road traffic to understand road traffic rules, have vehicle driving skills; meet age and health conditions as prescribed in point a, clause 1 and clause 2, Article 59 of the Law on Road Traffic Order and Safety.
Point a, Clause 1, Article 59 of the Law on Road Traffic Order and Safety stipulates the age of drivers and specialized motorbike drivers as follows: "Persons aged 16 and over are allowed to drive a motorbike".
Based on the above regulations, if her child meets the conditions, they are allowed to drive a motorbike with a capacity equivalent to no more than 50 cm3.
Documents required when participating in traffic are as follows:
Clause 1, Article 56 of the Law on Road Traffic Order and Safety stipulates that when participating in road traffic, drivers must bring the following documents:
Vehicle registration certificates or certified copies of vehicle registration certificates accompanied by original confirmation documents of credit institutions and foreign bank branches are still valid in cases where the vehicle is being mortgaged at credit institutions and foreign bank branches.
Driver's license is suitable for the type of vehicle being driven.
Certificate of technical safety and environmental protection inspection for motor vehicles according to the provisions of law.
Certificate of compulsory civil liability insurance of motor vehicle owners.
Based on the above regulations, her child, when driving a motorbike with a capacity of 50 cm3 to participate in traffic, must bring a vehicle registration certificate and valid motorbike insurance.
The Ministry of Public Security also said: Point a, Clause 1, Article 5 of the 2012 Law on Handling of Administrative Violations stipulates that people aged 16 and over are administratively sanctioned for all administrative violations.
Based on the above regulations, if Ms. D's child is eligible to drive a 50 cm3 vehicle, her child must be the main person responsible when participating in traffic.
