Analyzing cases of compensation for motorbike insurance, lawyer Nguyen Thu Trang, Deputy Director of Heva Law Firm LLC, said that there are two types of motorbike insurance: compulsory civil liability insurance for motor vehicle owners and voluntary insurance.
For compulsory civil liability insurance, the insurance unit does not compensate the vehicle owner for direct damage but compensates a third person when an accident occurs. For example, a motorbike driver who crashes into another person or causes damage to life, health and property can compensate the victims.
According to current regulations, in addition to compulsory civil liability insurance, there is also voluntary motorbike insurance.
Traffic participants can buy more to bring benefits of financial compensation for property or people on the vehicle (including the vehicle owner and passengers) in the event of an accident or incident.
Clause 3, Article 4 of Decree 67/2023/ND-CP stipulates that in addition to participating in compulsory insurance under insurance conditions, insurance fees, minimum insurance amounts or insurance liability limits prescribed in this Decree, the insurance buyer and the insurance company may negotiate in the insurance contract on expanding insurance conditions, increased insurance amounts and corresponding additional insurance fees in accordance with legal regulations. In this case, the insurance company is responsible for separating the compulsory insurance part in the insurance contract.
The State encourages agencies, organizations and individuals who are not subject to compulsory insurance according to the provisions of this Decree to buy insurance on the basis of agreement with insurance companies and in accordance with legal regulations.
In compulsory civil liability insurance of motor vehicle owners, for each motor vehicle, the responsibility for compulsory civil liability insurance compensation of motor vehicle owners only arises under a single insurance contract.
Thus, according to regulations, voluntary insurance is not mandatory but the state encourages people to buy more to ensure their rights.
Depending on each agreement, will people be compensated when their motorbikes are damaged during the storm? Normally, if the parties have an agreement on compensation for accidents such as natural disasters and floods, when motorbikes are damaged by the storm, people can be compensated.
