Voters in Ho Chi Minh City believe that implementing motorcycle emission inspections will result in vehicles that do not meet standards and should no longer be allowed to be used.
Therefore, voters recommend that the Ministry of Transport have a plan to deal with substandard vehicles and a plan to support people in difficult circumstances due to lack of means of transportation.
Responding to this issue, the Ministry of Transport said that the inspection of emissions of motorbikes and scooters is carried out in accordance with the provisions of the Law on Environmental Protection (Law on Environmental Protection) and the Law on Road Traffic Order and Safety (Law on Road Traffic Order and Safety).
Clause 2, Article 42 of the Law on Road Traffic Safety stipulates that motorbikes and mopeds are only subject to emission inspection. Emission inspection is carried out in accordance with the provisions of the law on environmental protection and is carried out at emission inspection facilities that meet national technical regulations.
Clause 1, Article 65 of the Law on Environmental Protection stipulates: means of transport must be inspected and certified by the inspection agency to meet environmental technical standards according to the provisions of law and international treaties to which the Socialist Republic of Vietnam is a member.
Point b, Clause 2, Article 102 also assigned the Ministry of Natural Resources and Environment to "Preside over and coordinate with the Ministry of Transport to submit to the Prime Minister for promulgation a roadmap for applying national technical standards and regulations on emissions of road motor vehicles circulating in Vietnam.
Thus, motorbikes in circulation are not required to have their emissions inspected from January 1, 2025 (when the Law on Road Traffic Safety takes effect), but will be implemented according to the roadmap for applying emission standards and regulations for road motor vehicles in circulation in Vietnam (roadmap).
Regarding the content of voters' recommendations on solutions for handling substandard vehicles and support plans for people in difficult circumstances due to lack of means of transportation, the Ministry of Transport responded as follows:
Currently, the roadmap is being chaired by the Ministry of Natural Resources and Environment, in coordination with relevant ministries and branches, to research and develop. The content of voters' recommendations will be one of the important contents in the process of researching and assessing policy impacts; the draft roadmap will be consulted with people, businesses and affected subjects according to the provisions of law before being submitted to the Prime Minister for consideration and promulgation.
The Ministry of Transport has issued Official Dispatch No. 10642/BGTVTKHCN&MT dated October 3, 2024 to the Ministry of Natural Resources and Environment and will closely coordinate with the Ministry of Natural Resources and Environment in the process of researching and assessing policy impacts to propose solutions for handling substandard vehicles and support plans for people in difficult circumstances who do not have means of transportation due to substandard vehicles in order to minimize impacts on life and ensure harmony of interests of people and the community.
