Ms. V.T.N in Tay Ninh asked, after the provinces and cities carry out the merger (from July 1, 2025), will the Ministry of Finance issue any new regulations or instructions on purchasing cars for departments, branches, and commune-level People's Committees? Will the form of car procurement change compared to the regulations in Circular No. 69/2024/TT-BTC?
Regarding this issue, the Ministry of Finance has the following opinion:
Pursuant to Point b, Clause 2, Article 53 of the Law on Bidding 2023, the Minister of Finance issued Circular No. 69/2024/TT-BTC dated October 1, 2024 regulating the list of goods and services subject to national centralized procurement (effective from November 15, 2024).
Including regulations on the scope of regulation, subjects of application and list of goods and services subject to national centralized procurement.
According to the provisions of Article 31, Article 52 of the Law on Management and Use of Public Assets 2017 and Article 3, Article 41 of Decree No. 186/2025/ND-CP dated July 1, 2025 of the Government:
The procurement of public assets is applied in cases where state agencies and public service units do not have assets or are still lacking assets compared to standards and norms but the State does not have assets to allocate and is not eligible for lease or contracted funding for the use of public assets, including cases of procurement to replace assets that meet the conditions for liquidation according to the provisions of law.
Based on the assigned budget estimate scope and the permitted funding sources, state agencies and public service units organize the procurement of public assets in accordance with the provisions of the law on bidding.
The organization of public asset procurement by centralized methods is carried out in accordance with the provisions of the law on bidding and the provisions of Chapter VI of Decree No. 186/2025/ND-CP dated July 1, 2025 of the Government.
