The Ministry of Public Security has just issued Circular No. 73/2024/TT-BCA regulating the patrol, control and handling of violations of the law on road traffic order and safety by traffic police (Circular 73). The Circular takes effect from January 1, 2025.
Article 21 of Circular 73 stipulates the end of patrol and control as follows:
At the end of the patrol and control period, the traffic police team must perform the following tasks:
Responsible Team Leader
Hold group meetings to draw experience, comment, evaluate advantages, shortcomings, propose ideas, record in the planning book and road traffic patrol and control diary about traffic order and safety, patrol, control and violation handling results, other related issues, propose, recommend and sign confirmation.
Report on the situation and results of the team.
Units and localities that have been equipped with the VNeCSGT App shall record the contents at Point a and Point b of this Clause on the VNeCSGT App.
Hand over to the unit's management staff: Records of administrative violations, related documents, exhibits, seized vehicles, on-the-spot fines, documents and images collected by professional technical equipment and means, other means; means of transport, professional technical equipment and means, weapons, support tools and other equipment.
The handover must be recorded in the book according to regulations, signed by the handover person and the recipient, with full name, and the person must be responsible to the head of the unit for the handover.
The Circular also stipulates the recording of the Road Traffic Patrol and Control Plan Book and Diary as follows:
When each incident is resolved, it must be recorded immediately in the planning book and the road traffic patrol and control diary (recorded briefly, clearly and continuously in chronological order).
For violations: Clearly record the time (hour, minute, day); location (km, place name, route, area); check the vehicle, license plate; driver; violation; handling measures of the Traffic Police: Warning (according to the provisions of the Law on Handling Administrative Violations), decision to impose warning, fine (decision number), administrative violation record (record number), application of preventive measures, other measures.
Traffic accidents, traffic jams, criminal activities and other incidents: clearly state the time (hour, minute, day), location (km, place name, route, area) of the incident; summary of the incident; results of resolution; coordinating forces.
Units and localities that have been equipped with the VNeCSGT App will record patrol and control logs on the VNeCSGT App.
