The Ministry of Construction is seeking opinions on the draft Circular regulating the order and procedures for inspection and exemption from initial inspection for motor vehicles and specialized motorbikes; and at the same time supplementing regulations on emission inspection of motorbikes and mopeds.
According to the assessment of the Vietnam Register, this draft is built with the important goal of ensuring that regulations can be effectively implemented in practice, overcoming obstacles that have arisen in the past.
The draft is being consulted until the end of April 21, 2026, in the context of increasingly high traffic management requirements, especially related to environmental protection and emission control.
Previously, Circular No. 47/2024/TT-BGTVT, effective from January 1, 2025, created a relatively complete legal basis for motor vehicle inspection, vehicle modification control and motorcycle emission inspection.
After more than a year of implementation, state management in the field of registration has been clearly improved, procedures are more transparent, creating convenience for people and businesses.
However, practice also shows some shortcomings and inadequacies. Some arising situations have not been fully regulated, causing confusion in the implementation process.
In addition, the National Assembly's promulgation of Law No. 118/2025/QH15 and the Government's promulgation of Decree No. 89/2026/ND-CP have raised the requirement to review and amend regulations to ensure the consistency of the legal system.
On that basis, the Vietnam Register proposed to develop a new Circular to replace Circular 47, focusing on amending and supplementing inappropriate regulations, and at the same time abolishing cumbersome procedures, creating more favorable conditions for people, businesses and management agencies.
A noteworthy point is that the draft supplements regulations on motorbike emission testing.
The draft Circular also clearly shows the direction of promoting digital transformation in the field of registration. Accordingly, the issuance of inspection certificates will gradually shift to electronic form. People can submit dossiers online, monitor processing status and receive results through the digital system.
The draft also emphasizes the principle of decentralization, increasing the proactiveness of registration facilities and vehicle owners. Some procedures are simplified, shortening processing time, in which the time to process emission inspection dossiers for the first time may only be up to 3 working hours if the dossier is valid.
For motorbikes under 5 years of use, vehicle owners can carry out procedures for exemption from the first emission inspection through dossiers.
For vehicles over 5 years old, the vehicle must be actually inspected at the registration center before issuing the certificate.
This draft aims to build a process for testing motorbike emissions that is both strict in management and flexible in implementation.
According to the Ministry of Construction, perfecting policies not only contributes to controlling emissions and protecting the environment but also ensures feasibility, avoiding unnecessary pressure on people and businesses.
