Vietnam Register Department talks about proposal to inspect motorcycle emissions

The Ministry of Construction is drafting regulations on new registration, including regulations on motorbike emission inspection.

The Ministry of Construction is seeking opinions on the draft Circular regulating the order and procedures for inspection and exemption from initial inspection for motor vehicles and specialized motorbikes; order and procedures for technical safety certification and environmental protection for converted motor vehicles and converted specialized motorbikes; order and procedures for emission inspection of motorbikes and mopeds. The draft will be consulted until the end of April 18, 2026.

Explaining the necessity of this draft, the Vietnam Register Department said about the practical basis as follows:

On November 15, 2024, the Government issued Circular No. 47/2024/TT-BGTVT stipulating the order and procedures for inspection, exemption from initial inspection for motor vehicles and specialized motorbikes; order and procedures for technical safety and environmental protection certification for converted motor vehicles and converted specialized motorbikes; order and procedures for emission inspection of motorbikes and mopeds, effective from January 1, 2025.

Over more than a year of implementation, it has contributed to improving the effectiveness and efficiency of state management of inspection activities.

However, in actual implementation, some shortcomings, obstacles, and inadequacies have arisen, along with the National Assembly issuing Law No. 118/2025/QH15 and the Government issuing Decree No. 89/2025/ND-CP, so some situations have arisen that need to be amended and supplemented with regulations such as:

Amending and supplementing regulations on handling cases arising in the inspection of motor vehicles, specialized motorbikes and in the inspection of emissions of motorbikes and mopeds to cover all cases arising in practical implementation.

Supplementing the responsibility of registration facilities in certifying technical safety and environmental protection for renovating converted motor vehicles and specialized modified motorbikes to comply with the regulations assigned in the Law on Road Traffic Order and Safety amended and supplemented by Law No. 118/2025/QH15.

Supplementing regulations on the issuance of electronic certificates in the spirit of implementing Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science, technology, innovation and national digital transformation.

Supplement regulations on posting and removing information about violating vehicles to be consistent with the regulations assigned in the Law on Road Traffic Order and Safety amended and supplemented by Law No. 118/2025/QH15 and Decree No. 89/2026/ND-CP.

Amending and supplementing regulations on renovation certification to be consistent with reality and international practices to facilitate implementation and create favorable conditions for people and businesses.

Amending and supplementing the responsibilities of management agencies to improve the effectiveness and efficiency of state management; as well as the responsibilities of registration facilities, registration officers and vehicle owners in inspection and certification of renovation.

Review and expand cases of motor vehicles that have changed but are not considered renovated vehicles and do not need to prepare design documents (such as changing the front lighting cluster, installing covers for pickup truck cargo compartments, etc.) to reduce time and costs for vehicle owners.

Regarding motorbike emission testing, previously, the Prime Minister stipulated that Hanoi and Ho Chi Minh City will test emissions from motorbikes and mopeds from July 1, 2027.
