The Ministry of Construction is seeking opinions on the draft Circular regulating the order and procedures for inspection and exemption from initial inspection for motor vehicles and specialized motorbikes; order and procedures for technical safety certification and environmental protection for converted motor vehicles and converted specialized motorbikes; order and procedures for emission inspection of motorbikes and mopeds. The draft will be consulted until the end of April 18, 2026.
One of the notable points of the draft is the proposal for the order and procedures for testing motorbike emissions as follows:
1. Submit application
Depending on the subjects specified in Article 10, Article 11, Article 12 of this Circular, vehicle owners choose any registration facility nationwide to submit 1 set of dossiers according to the corresponding regulations online on the electronic information page or registration application of the Vietnam Register or submit directly or through the postal system to the registration facility.
2. For cases of initial inspection of vehicles with a time from the year of manufacture not exceeding 5 years:
Registration facilities receive, inspect dossier components and return results within a maximum of 3 working hours from the time of receipt of the dossier, specifically as follows:
a) In case the dossier is complete and appropriate, the vehicle has not been granted an emission inspection certificate, the vehicle is not subject to inspection refusal and has vehicle registration data shared from the vehicle registration agency:
For electronic dossiers, the registration agency registers confirmation in the Certificate of Receipt of Exemption from Inspection dossiers, the system automatically issues a dossier receipt number and sends it to the vehicle owner, prepares vehicle dossiers through the inspection management software of the Vietnam Register and prepares vehicle dossiers.
For paper dossiers, registration facilities shall prepare inspection control forms according to the forms specified in Appendix IV issued together with this Circular, prepare vehicle dossier forms and prepare vehicle dossiers.
b) In case the vehicle dossier is incomplete or inappropriate; the vehicle has been granted an emission inspection certificate; the vehicle falls into the case of being refused inspection or there are no vehicle registration data shared from the vehicle registration agency, the vehicle registration agency returns the dossier corresponding to the form of receiving the dossier and issuing a notice of non-conformity according to the form specified in Appendix I issued together with this Circular for vehicle owners to supplement and amend.
c) Issuance of emission inspection certificates
Within 3 working hours from the time of receiving complete and valid dossiers, the registration agency shall base on the dossier requesting the procedure for issuing a certificate of emission inspection for motorbikes and mopeds (electronic version) according to the form specified in form No. 09 of Appendix XX issued together with this Circular on the online system (for electronic dossiers) or issue a Certificate of emission inspection for motorbikes and mopeds (paper version) directly to the vehicle owner (for paper dossiers), the validity period of the certificate is specified in Appendix V issued together with this Circular.
3. For cases of initial inspection of vehicles with a time from the year of manufacture exceeding 5 years:
The vehicle owner must bring the vehicle to the Registration Facility, the Registration Facility receives, checks the dossier components and returns the results within a maximum of 3 working hours from the time of receiving the dossier, specifically as follows:
a) In case the dossier is complete and appropriate, the vehicle is not subject to inspection refusal and has vehicle registration data shared from the vehicle registration agency:
For electronic dossiers, the registration facility registers confirmation in the Certificate of Reception of Exemption from Inspection, the system automatically issues a dossier receipt number, prepares a notice on the emission inspection time according to the form specified in form No. 03 of Appendix VI issued with this Circular and sends it to the vehicle owner, prepares vehicle dossier forms through the inspection management software of the Vietnam Register, prepares vehicle dossiers; for paper dossiers, the registration facility prepares inspection control forms according to the form specified in Appendix IV issued with this Circular, prepares vehicle dossier forms and prepares vehicle dossiers. Conducts emission inspection, issues inspection certificates according to the provisions at points c, d, clause 4 of this Article.
b) In case the vehicle dossier is incomplete or inappropriate, the vehicle falls into the case of being refused inspection or there are no vehicle registration data shared from the vehicle registration agency, the vehicle registration agency returns the dossier corresponding to the form of receiving the dossier and issuing a notice of failure according to the form specified in Appendix I issued with this Circular for vehicle owners to supplement, amend, and rectify.
