Is parking on the deceleration curb fined under Decree 168?

Many people wonder whether parking on the deceleration curb will be penalized according to Decree 168/2024/ND-CP or not?

Talking to a reporter of Lao Dong Newspaper, lawyer Nguyen Thu Trang - Deputy Director of Heva Law Company Limited said that Decree 168/2024/ND-CP regulating penalties for administrative violations in the field of road traffic order and safety; deducting points, restoring points for driver's licenses is still of great interest to many people.

First, we need to understand the locations where parking is not allowed. According to Clause 4, Article 18 of the 2024 Law on Road Traffic Order and Safety, drivers of vehicles participating in road traffic are not allowed to stop or park at certain locations.

Specifically including: On the left side of a one-way street; on curved roads or near the beginning of the slope where visibility is obscured; on bridges, under overpasses except for permitted places; parallel in the same direction to other vehicles stopping and parking; on the sidewalk for pedestrians crossing the street; at the intersection and within a radius of 5 meters from the edge of the intersection; pick-up and drop-off points; in front of the gate and within a radius of 5 meters on both sides of the gates of agencies and organizations with roads for vehicles to enter and exit.

In addition, there are also locations such as places where the road section is only sufficient for one lane for motorized vehicles; within the safety scope of the railway; obscuring road signs and traffic lights; on roads reserved for buses; on drainage culverts, tunnels of telephone lines, high-voltage power lines; places reserved for fire trucks to take water; on roads and sidewalks in violation of the law.

According to lawyer Nguyen Thu Trang, Decree 168 does not directly regulate the act of parking on a decelerator. Therefore, if parking is only at this location, there is no basis for separate penalties for parking on a decelerator.

However, people still need to pay attention to other related acts to avoid being penalized according to regulations.

According to Clause 6, Article 18 of the Law on Road Traffic Order and Safety 2024, cars are not allowed to stop or park less than 20 meters away from cars parked in the opposite direction on narrow streets or less than 40 meters away on roads with one lane for motorized vehicles on one side of the road.

In addition, point d, clause 3, Article 6 of Decree 168/2024/ND-CP stipulates a fine of between VND 800,000 and VND 1 million for drivers who perform the act of stopping or parking at road intersections or within a radius of 5 meters from the edge of the road intersection; pick-up and drop-off points; in front of the gate or within a radius of 5 meters on both sides of the headquarters gate of agencies and organizations with roads for vehicles to enter and exit; where the road section has a width only sufficient for one motor vehicle lane; obscuring road signs and traffic lights; where the median strip is opened; less than 20 meters away from cars parked in the opposite direction on narrow streets or less than 40 meters away on roads with one motor vehicle lane in one direction.

Therefore, although there are no separate regulations on parking on deceleration rails, vehicle drivers still need to carefully observe the stopping and parking positions to avoid violating other regulations of road traffic law.
