Lao Dong Newspaper has published an article about the illegal purchase and transfer of social housing (NOXH) at the Dai Thang residential area social housing project (Pho Yen ward, Thai Nguyen province) invested by TNG Land Joint Stock Company.
Accordingly, many social housing apartments in this project have not been handed over, but real estate brokers and owners have publicly advertised for sale at prices different from the price signed with the investor from 200 - 500 million VND/unit, depending on the area.
For example, a 36m2 1-bedroom apartment with a selling price of about 700 million VND is more than 200 million VND higher than the original price. A 2-bedroom apartment with an area of over 62m2 is being offered for sale at over 1.4 billion VND, a difference of over 450 million VND compared to the original price.
The illegal purchase and transfer of social housing apartments here is carried out in the form of making documents, containing many legal risks.
On November 12, Lao Dong Newspaper reporters had a meeting with representatives of the Department of Construction of Thai Nguyen province and TNG Land Joint Stock Company to clarify the contents of the reflection.
At the meeting, a representative of the Department of Construction of Thai Nguyen province said that immediately after receiving feedback, the Department of Construction issued document No. 3489 requesting the investor to report on the purchase and sale of apartments at the Dai Thang Residential Area Social Housing Project for synthesis and reporting to the People's Committee of Thai Nguyen province and the Ministry of Construction according to regulations.
The provincial Department of Construction requested TNG Land Joint Stock Company to report the actual situation at the project, including the number of apartments that have signed sales and lease-purchase contracts. Information about the cases reported shows signs of transfer or sale in violation of regulations. Responsibility for management and supervision of investors in preventing and handling violations (if any).
"The Department of Construction also requires investors to clearly explain the contents related to whether or not there are transactions, brokers buying, selling, and transferring social housing apartments in the project when they do not meet the conditions. At the same time, investors are requested to take measures to prevent this situation," said a representative of the Thai Nguyen Department of Construction.

Also according to the representative of the Department of Construction of Thai Nguyen province, this is the first social housing project in the locality to be completed and ready to be put into use, so it is of great interest to the public. Therefore, the authorities will strictly handle if violations are discovered.
On the investor's side, Mr. Ha Van Giang - Executive Director of TNG Land Joint Stock Company said that after receiving feedback from Lao Dong Newspaper and a request from the Department of Construction of Thai Nguyen province, the company had reported the incident.
"Immediately after the reflection, the investor issued a notice to the entire system of agents and sales staff at the project to strictly prohibit consulting, brokerage or illegal transfers of social housing when not qualified.
At the same time, the company also sent a warning to customers about the risks of illegal social housing transfers," said Mr. Giang.
According to Mr. Giang, up to now, the investor has not received any requests from customers to propose terminating or changing the customer entities in social housing purchase and sale contracts.

"We are continuing to coordinate with the Department of Construction and authorities to verify and handle cases with signs of violations. However, this is quite difficult because illegal transactions are all conducted in the secondary market," Mr. Giang added.
The report of TNG Land Joint Stock Company shows that up to now, the total number of apartments that have signed sales contracts in the Dai Thang residential area social housing project is 366/395 apartments. The contract with 366 customers clearly stipulates that social housing buyers are not allowed to resell their houses for at least 5 years.
Speculation, inflating social housing prices
The investigation process of PV found that there was a situation of social housing speculation at Dai Thang residential area project, when some people actually owned many apartments here, the apartments were all under the names of relatives, then sold them at a difference of hundreds of millions of VND.
According to real estate brokers in Thai Nguyen, of the nearly 400 apartments in the Dai Thang residential housing project, about 40% are owned by speculators.
To circumvent the law and deal with authorities, the transfer of social housing without enough time is carried out in the form of making a notarized document. Both real estate brokers and speculators know this is a violation of the law, but for profit they still ignore it.
Illegal transfer of social housing by making a record is a form of house sale and purchase that is not recognized by law and will cause serious legal risks, and buyers may even lose billions of dong.
Meanwhile, social housing speculation is considered a form of profiteering from social security policies. Because social housing benefits from many preferential policies of the State to reduce selling prices, creating conditions for low-income workers to have the opportunity to own.
Speculation and inflation of social housing prices not only distort the real estate market but also push up housing prices, depriving low-income people of settling down and making a living, causing injustice in society.
