The Gia Vien District Commune Disciplinary Council for Civil Servants held a meeting and unanimously proposed that the Chairman of the Gia Vien District People's Committee issue a disciplinary warning decision according to his authority against Mr. Bui Hong Quan, a civil servant of the Department of Land - Agriculture - Construction and Environment of Gia Tran Commune (formerly a civil servant of the Department of Land - Agriculture - Construction and Environment of Gia Xuan Commune) and Mr. Nguyen Luong Chung, a civil servant of Finance - Accounting of Gia Xuan Commune.
During their time working at Gia Xuan Commune People's Committee, Mr. Quan and Mr. Chung were civil servants directly advising the Commune People's Committee on land management and use.
However, Mr. Quan and Mr. Chung were irresponsible in advising and, together with the Commune People's Committee, signed a contract for Mr. Nguyen Ngoc Ha - Director of Tan Phu Do Investment and Trading Company Limited - to rent 1,100 square meters of land, which was not in accordance with the provisions of Clause 3, Article 132 of the 2013 Land Law.
Some of the contents and terms in the contract were not strict enough, leading to Nguyen Ngoc Ha (the land lessee) relying on the terms stated in the contract to level the entire leased area, construct construction items, install machinery and equipment, and operate the production of concrete components.
The Gia Vien District Commune Disciplinary Council for Civil Servants assessed that the actions of Mr. Quan and Mr. Chung violated the provisions of the law on the performance of duties and responsibilities of officials and civil servants and were the first violations, causing serious consequences in one of the cases specified in Clause 1, Article 8 and Clause 2, Article 9 of Decree 112/2020/ND-CP of the Government.
Gia Vien District People's Committee also requested the Standing Committee of the District Party Committee to inspect and clarify the responsibilities of the Standing Committee of Gia Xuan Commune Party Committee for the 2015-2020 and 2020-2025 terms in leading and directing Gia Xuan Commune People's Committee on land management in the locality.
For Gia Xuan Commune People's Committee, it is required to seriously review the responsibility for state management of land. Continue to review and clarify the responsibility of relevant groups and individuals for violations in 2016. Develop a plan to remedy the consequences of violations to ensure compliance with regulations.
As for Mr. Bui Quang Canh - Chairman of Gia Xuan Commune People's Committee, it is recommended that the District Standing Committee consider and handle administrative discipline in the form of a warning on the grounds that Mr. Canh committed a violation causing serious consequences, allowing the incident to drag on, causing public outrage in the locality and making it difficult to overcome the consequences.
Previously, Lao Dong Newspaper had a series of articles reflecting on the violations of Gia Xuan Commune People's Committee in signing a contract to lease 1,100m2 of land to Mr. Nguyen Ngoc Ha - Director of Tan Phu Do Investment and Trading Company Limited - against regulations. After being leased the land, Mr. Nguyen Ngoc Ha encroached on a part of the area belonging to the power grid safety corridor to illegally build a concrete component manufacturing facility, causing environmental pollution.
