Ms. B.T.P in Dong Thap reflected that she has a plot of land of the type of CLN, with a land use term of October 15, 2043. Now she has an agreement to buy a part of the adjacent land plot for the same purpose of using the CLN, but the land use term is until July 26, 2017.
Because the land Ms. P bought was not enough to limit the division of the plot, it needed to be merged into her existing plot of land.
Ms. P asked, are there any instructions or regulations on adjusting the land use term for 2 plots of land with the same term to be merged?
The Ministry of Agriculture and Environment responds to this issue as follows:
Pursuant to the provisions of Clause 3, Article 220 of the 2024 Land Law, the merger of land plots must ensure a number of conditions, including the same land use term, except in cases where the entire or part of the land plot has residential land and other land in the same plot of land and in cases where the land plot has residential land and other land in the same plot of land as the residential land plot.
Therefore, in the case of Ms. P's question that the two plots of land have different land use term, the current land law has not yet regulated administrative procedures to adjust the land use term.
