Chairman of the People's Committee at the commune level is granted a red book for the first time

According to Article 5 of Decree No. 151/2025/ND-CP of the Government on the division of authority between local authorities at two levels in the land sector, from July 1, the Chairman of the People's Committee at the commune level will have the authority to sign and issue land use right certificates (red books) to domestic individuals, overseas Vietnamese who are Vietnamese citizens and the community.

In addition, the People's Committee at the commune level is also authorized to perform tasks such as approving compensation, support and resettlement plans; approving enforcement plans for implementing land recovery decisions and enforcement costs; deciding on specific land prices; deciding on resettlement housing prices in the area.

Procedures for issuing red books for the first time have been shortened

Decree No. 151/2025/ND-CP also stipulates the time for carrying out procedures for registration of land, assets attached to land, and issuance of red books.

Accordingly, the first registration of land and assets attached to land must not exceed 17 working days; the first issuance of a certificate must not exceed 3 working days.

Compared to the current regulations in Clause 1, Article 22 of Decree No. 101/2024/ND-CP, the registration period can be up to 20 working days, while the time for granting the certificate remains the same as 3 working days.

From July 1, the time for carrying out procedures for land change registration, issuance or issuance of red books ranges from 1-20 working days depending on each specific case.

In which, cases of transfer, donation, inheritance, capital contribution of land use rights or assets attached to land shall not exceed 8 working days.

Change of land user information or land plot address for no more than 4 working days.

The correction of the issued red book must not exceed 8 working days, and the change of land use purpose must not exceed 7 working days.

Can arbitrarily choose the place to submit documents in the same province or city

According to Clause 1, Article 18 of Decree 151/2025/ND-CP, from July 1, people can choose to submit land registration documents at any unit in the same province or city, instead of only submitting them at the place where the land is located as before.

This regulation applies to the dossiers mentioned in Clause 3 and Clause 4, Article 21 of Decree No. 101/2024/ND-CP, including the dossier for initial registration of land and assets attached to land and the dossier for registration of changes in land and assets attached to land.

No need to confirm the land in accordance with the planning, no disputes, stable use:

Clause 4, Article 18 of Decree 151/2025/ND-CP stipulates that when carrying out procedures for granting red books, commune-level People's Committees do not need to carry out alone the confirmation of compliance with the planning, there are no disputes and land is used stably as before.

This will help shorten processing time and reduce administrative procedures.
