1. What is apartment building consolidation?
According to Clause 3, Article 3 of Decree 98/2024/ND-CP, the consolidation of apartment buildings for renovation and reconstruction is the relocation of owners and users of 02 or more independent apartment buildings in the same commune-level area or the same district-level area or in neighboring districts to build new apartment buildings at 1 or 2 locations with consolidated apartment buildings to arrange resettlement for all owners and users of apartment buildings subject to relocation.
At the same time, Clause 3, Article 6 of Decree 98/2024/ND-CP also stipulates that based on the actual location of independent apartment buildings that are subject to demolition but cannot be invested in rebuilding apartment buildings or can be rebuilt but cannot ensure the socio-economic efficiency of the project, when organizing the preparation and approval of the planning, the Provincial People's Committee decides on solutions to collect apartment buildings to ensure the socio-economic and environmental efficiency of the project, associated with urban renovation and embellishment.
2. Cases of apartment building consolidation from August 1, 2024
Cases of apartment building consolidation are stipulated in Article 37 of Decree 98/2024/ND-CP as follows:
(1) Collect a number of independent apartment buildings in the same ward area into 01 or 02 locations with apartment buildings subject to collection in that ward area.
(2) In case the same ward-level area cannot carry out the collection as prescribed in Clause (1), the collection of a number of apartment buildings in neighboring wards within the same district-level area shall be carried out.
(3) In case the same district-level area cannot carry out the collection as prescribed in Clause (2), the collection of a number of apartment buildings in neighboring districts shall be carried out.
(4) In case it is not possible to implement the collection solution as prescribed in the above-mentioned clauses, the Provincial People's Committee shall advance funds from the local regular expenditure budget to relocate, compensate, support, and resettle the owners and users of this apartment building and organize an auction of the land with the apartment building to be demolished to refund the money to the state budget. The investment in construction of works on the auctioned land shall be carried out according to the approved planning.
In case according to the approved planning, the land with apartment buildings is subject to the collection and must be arranged for public works, compensation, clearance, demolition and land recovery shall be carried out according to the provisions of the law on land to implement the planning.
