On December 19, the Ministry of Justice posted documents assessing the draft Decree regulating the rearrangement and handling of public assets.
According to the Ministry of Finance - the agency drafting the draft Decree, the policy on rearrangement and handling of houses and land has been gradually improved over time. The Ministry of Finance and ministries, branches and localities have made many efforts in organizing implementation.
However, the overall progress of rearranging and handling public houses and land is still slow.
According to reports sent to the Ministry of Finance by ministries, branches and localities, the total number of housing and land facilities under the arrangement scope up to now is 262,703 facilities.
The competent authority has approved the plan to rearrange and handle 201,951 facilities.
However, there are still 60,752 facilities whose plans have not been approved by competent agencies or individuals (accounting for about 23.13%); the organization and implementation of the plans after they are approved still face difficulties and problems, and some plans have not been completed after many years.
The reason for this situation is that the rearrangement and handling of houses and land is quite complicated because the management of houses and land has not received proper attention for a long time.
The origin of houses and land is formed through many stages, the record keeping is incomplete and not taken care of, so it is lost, affecting the progress of house and land arrangement.
Many agencies, organizations, units, enterprises and some ministries, central and local agencies have not really paid attention to the work of rearranging and handling houses and land.
In addition, the coordination between localities is not timely, many localities are slow to announce planning or the planning is unclear while the rearrangement and handling of houses and land requires combining many information factors (planning, land use plans, construction plans, usage needs to serve the activities of agencies, organizations, units, enterprises, etc.) or the Provincial People's Committee (where the houses and land are located) is slow to give opinions on the plan to rearrange and handle houses and land.
The rearrangement and handling of houses and land is related to many different laws such as: land law, law on management and use of state capital invested in production and business at enterprises, housing law...
Therefore, according to the Ministry of Finance, the Government's issuance of a Decree regulating the rearrangement and handling of public assets (replacing Decree 167/2017/ND-CP, Decree 67/2021/ND-CP) is necessary, urgent and has a legal and practical basis.
