According to notices from No. 163 to 171/TB-UBND, Phu Dien Ward People's Committee announced the recovery of 77.4m2 of land for many cases to implement the Giao Luu City Urban Area project. Specifically, the recovered area belongs to a part of land plot No. 114, map sheet No. 08 in Cau Dien town (now Phu Dien ward).
According to Notice No. 163/TB-UBND, the cases of land acquisition include Mr. V.V.Th and Mr. V.V.T. Notice No. 164/TB-UBND mentions the case of Ms. N.T. B. P. Notice No. 167/TB-UBND applies to Mr. V.Q. H.
Notice No. 168/TB-UBND states the land recovery for co-heirs according to legal regulations of Ms. N.T. Kh. Meanwhile, Notice No. 169/TB-UBND applies to Mr. M.P.D and Ms. D. T. N.
According to Notice No. 170/TB-UBND, the case of land acquisition is Mr. N.X. T. As for Notice No. 171/TB-UBND, Phu Dien Ward People's Committee announced the land acquisition for Mr. D. H. L and Ms. D. T. H.
In the above notices, the type of land to be recovered is identified as non-agricultural land.
According to the notices, the Phu Dien Ward Infrastructure Investment Project Management Board shall preside over and coordinate with relevant units to receive and send notices to land users, owners of assets attached to land, and people with related rights and obligations (if any) within the scope of land recovery to know and implement.
In case there is no contact, no notice of land recovery can be sent to the person whose land is recovered, the owner of assets attached to the land or people with related rights and obligations (if any), the implementation will be according to the provisions of point b, clause 2, Article 87 of the 2024 Land Law.
Phu Dien Ward People's Committee also organized public posting of land acquisition notices at the Ward People's Committee headquarters and common activity points of residential areas where land is recovered; and at the same time announced on the radio system and mass media in the ward.
In the process of implementation, if information changes arise compared to the issued land acquisition notice such as land users and land plot information, the Investment - Infrastructure Project Management Board will summarize and send it to the Economic, Infrastructure and Urban Department to report and advise Phu Dien Ward People's Committee to issue an adjustment notice.
Land users, owners of assets attached to land and people with related rights and obligations (if any) are responsible for coordinating with the Investment - Infrastructure Project Management Board and Phu Dien Ward People's Committee to conduct investigations, surveys, record the current status, measure, count, statistics, and classify the recovered land area and assets attached to recovered land to develop compensation, support, and resettlement plans.
In case of non-compliance with the investigation, survey, record of current status, measurement, inventory, statistics, classification of recovered land area and assets attached to recovered land, the State will carry out mandatory inventory according to the provisions of law.
The notices also clearly state that assets attached to land created contrary to the provisions of law or created from the date of issuance of the notice will not be compensated according to the provisions of Clause 2, Article 105 of the 2024 Land Law.
