The Ministry of Agriculture and Environment received a petition from voters in An Giang province with the content: Voters proposed that some legal regulations related to land are still overlapping and unconsistent between laws and guiding documents, causing confusion in the application process. It is proposed that competent authorities review and adjust to ensure synchronization and unity in implementation.
Answering this content, the Ministry of Agriculture and Environment said:
On January 18, 2024, at the 5th Extraordinary Session, the 15th National Assembly passed the Land Law No. 31/2024/QH15 (Land Law 2024). The Land Law 2024 has many new breakthrough and important contents contributing to the goal of perfecting institutions and policies, improving the effectiveness and efficiency of land management and use. In the process of perfecting policies and laws on land, the drafting agency has organized a review of relevant laws to ensure the unity and synchronization of the legal system.
Implementing the direction of the Politburo, the National Assembly, the Government and the Prime Minister on reorganizing the apparatus, building a 02-level local government model and promoting administrative procedure reform in the field of land, the Ministry of Agriculture and Environment has coordinated with ministries, branches, and localities to assess the process of organizing the implementation of the Law, review overlapping and unsynchronized legal regulations, propose contents that need to be amended and supplemented to the Land Law to meet the requirements of 02-level local governments, and at the same time remove difficulties and obstacles to continue promoting land resources for national development in the new era, specifically:
- On December 11, 2025, at the 10th Session, the Ministry of Agriculture and Environment advised the Government to submit to the National Assembly for approval Resolution No. 254/2025/QH15 stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, effective from January 1, 2026.
- The Ministry of Agriculture and Environment has submitted to the Government for promulgation the following Decrees: No. 151/2025/ND-CP dated June 12, 2025, regulating the decentralization of authority of local authorities at 02 levels, decentralization and decentralization in the field of land; No. 226/2025/ND-CP dated August 15, 2025, amending and supplementing a number of articles of Decrees detailing the implementation of the Land Law; No. 49/2026/ND-CP dated October 31, 2025, detailing and guiding a number of articles of Resolution No. 254/2025/QH15 of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, including amending, supplementing, and perfecting regulations on compensation, support, resettlement, and determining land prices.
- Since the National Assembly promulgated the 2024 Land Law, the National Assembly has promulgated 11 specialized laws with content related to land policies and laws. At the same time, the National Assembly and the Government have issued pilot Resolutions to remove difficulties and obstacles in the process of applying the Land Law.
The Ministry of Agriculture and Environment will continue to closely monitor the implementation of the 2024 Land Law, Resolution No. 254/2025/QH15 and guiding documents for implementation; summarize difficulties and obstacles from ministries, branches, and localities to promptly guide, report and advise competent authorities for consideration and resolution.
