On the Government Information Portal, Ms. P.T.D in Da Nang asked: At the time of determining the starting price for auctioning land use rights for that plot of land, if the market price is much higher than the price of the land price list, can the specific land price be used to calculate the starting price of that plot of land or is it mandatory to use the land price list?
The Ministry of Agriculture and Environment responds to this issue as follows:
The determination of starting price will be applied according to a specific price list or price based on whether the land area to be valued has been built with technical infrastructure or not?
In case the land plot or land area has been invested in technical infrastructure according to the detailed construction plan and is eligible to apply the land price list as prescribed in Point i, Clause 1, Article 159 of the 2024 Land Law, the land price list will be applied.
When applying the land price list, if necessary, the provincial People's Committee decides to adjust the land price list according to the provisions of Clause 1, Article 257 of the 2024 Land Law.
In addition to the cases of applying the land price list as prescribed in Point i, Clause 1, Article 159 of the 2024 Land Law, specific land prices will be applied to determine the starting price for auctioning land use rights when the State allocates or leases land.
