On the Government Portal, Mr. P.H wondered:
Mr. P.H is single, has an income of about 8 million VND/month and has signed a labor contract with the company.
However, when verifying the subject, Mr. P.H could not determine whether he belonged to the group of 5 low-income people in urban areas or the group of 6 workers in enterprises. He requested functional agencies to support and answer.
The Ministry of Construction answers this question as follows:
Article 76 of the 2023 Housing Law stipulates the groups of subjects entitled to housing support policies as follows:
1. People with meritorious services to the revolution, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution.
2. Poor and near-poor households in rural areas.
3. Poor and near-poor households in rural areas in areas frequently affected by natural disasters and climate change.
4. Poor and near-poor households in urban areas.
5. Low-income people in urban areas.
6. Workers and employees working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks.
7. Officers, professional soldiers, non-commissioned officers of the People's Armed Forces, police workers, civil servants, national defense workers and public employees serving in the army; people working in cipher work, people working other jobs in cipher organizations receiving salaries from the state budget who are working.
8. Cadres, civil servants, public employees according to the provisions of law on cadres, civil servants, public employees.
9. Subjects who have returned official residences according to the provisions of Clause 4, Article 125 of this Law, except in cases where official residences are recovered due to violations of the provisions of this Law.
10. Households and individuals subject to land acquisition and must have houses cleared and demolished according to the provisions of law that have not been compensated by the State with houses and residential land.
11. Students of universities, academies, universities, colleges, vocational schools, specialized schools according to the provisions of law; students of public ethnic minority boarding schools.
12. Enterprises, cooperatives, and cooperative unions in industrial parks".
According to Clause 4, Article 3 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on development and management of social housing:
4. Low-income subjects specified in Clause 5, Article 76 of the Housing Law are people with income levels specified in Article 30 of this Decree".
Cases where subjects of Clause 5, Article 76 of the Housing Law do not have labor contracts
Article 30 of Decree No. 100/2024/ND-CP (amended and supplemented by Decree No. 54/2026/ND-CP dated February 9, 2026) stipulates:
1. For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
a) In case the applicant is a non-married person or is certified as single, the average monthly actual income does not exceed 25 million VND calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
...2. In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract, it must ensure income conditions as prescribed in Clause 1 of this Article and be certified by the commune-level police agency where the citizen is permanently or temporarily residing or currently residing. Within 7 days from the date of receiving the request for confirmation, the commune-level police agency where the citizen is permanently or temporarily residing or currently residing at the time of the citizen's request, is responsible for confirming information including: Full name, middle name; Date, month, year of birth; gender; personal identification number; date, month, year of issuance of citizen identification card/identity card; place of permanent residence/temporary residence/current place of residence.
Citizens are responsible for declaring and committing to information on average monthly income. Commune-level police coordinate with relevant agencies in verifying and post-checking information on average monthly income of citizens for necessary cases.
The application form confirming the income conditions specified in this clause is also a document proving the beneficiaries of social housing support policies".
Cases where subjects under Clause 5, Article 76 of the Housing Law have labor contracts
The confirmation of subjects and income is carried out by the agency, unit, and enterprise where the declarant is working (according to Form No. 01a in the Appendix attached to Circular No. 32/2025/TT-BXD dated November 10, 2025 of the Minister of Construction amending and supplementing a number of articles of Circular No. 05/2024/TT-BXD dated July 31, 2024 of the Minister of Construction detailing a number of articles of the Housing Law). It is requested that you base on the above regulations, compare with your case to implement.
