Hanoi proposes to abolish regulations on renovating old apartment buildings after nearly 18 years

Hanoi - The Department of Construction proposes to abolish Decision 48/2008 on renovating and rebuilding old apartment buildings because they are no longer suitable.

Hanoi Department of Construction is submitting to the City People's Committee for promulgation a decision to abolish the entire Decision No. 48/2008/QD-UBND on the Regulation on renovation and reconstruction of old, damaged and degraded apartment buildings in the area.

According to the Hanoi Department of Construction, after nearly 18 years of implementation, Decision No. 48/2008/QD-UBND is no longer consistent with the current legal system when many contents have been replaced and updated in the 2023 Housing Law and guiding documents for implementation.

The drafting agency said that previously Decision No. 48 stipulated many contents related to the renovation and reconstruction of apartment buildings in the city. However, these regulations have now been fully and more specifically adjusted by the 2023 Housing Law.

Accordingly, the 2023 Housing Law details the planning and plan for renovating old apartment buildings; construction quality inspection; determination of the term of use of apartment buildings; order and procedures for deciding on investment policies; investor selection; compensation and resettlement policies; as well as forced relocation and demolition of works.

Therefore, the Hanoi Department of Construction believes that continuing to maintain Decision No. 48 is no longer necessary because the entire content of the adjustment has been uniformly regulated in current law.

In addition, the Law on Promulgation of Legal Documents in 2025 stipulates that legal documents can only be abolished in writing by the issued agency itself. Therefore, the Department of Construction proposes that the City People's Committee issue a decision to abolish the entire Decision No. 48/2008/QD-UBND to ensure the constitutionality, legality and unity of the legal system.

Notably, the Hanoi Department of Construction affirmed that the abolition of Decision No. 48 does not mean a lack of legal basis to implement the renovation and reconstruction of old apartment buildings. This activity is currently directly regulated by the 2023 Housing Law and Decree No. 98/2024/ND-CP with a more synchronous and specific regulation system, creating a unified legal corridor to implement old apartment building renovation projects in the city.

According to the Hanoi Department of Construction, reviewing and repealing inappropriate legal documents is a regular task to ensure the consistency of the legal system. At the same time, this is also one of the solutions to serve the goals of urban development, urban embellishment, urban reconstruction and promote the growth of the construction industry according to the city's socio-economic development programs and plans for the period 2025-2030.
