A resident in Ho Chi Minh City said that the family currently does not have a separate house and is living with relatives. The couple has two young children, one of whom has intellectual disabilities. The husband works under a labor contract with a salary of about 12-13 million VND/month, while the wife both takes care of the children and does small business, so there is no labor contract.
People are wondering whether in the above circumstances they can participate in buying or renting social housing.
Answering this question, the Ministry of Construction said that Clause 5, Article 76 of the 2023 Housing Law stipulates that "low-income people in urban areas" are one of the subjects entitled to social housing support policies.
According to the Ministry of Construction, to be able to buy or rent social housing, people not only belong to the group of beneficiaries but also must simultaneously meet the conditions on housing and income according to the provisions of Articles 29 and 30 of Decree No. 100/2024/ND-CP. These regulations have been amended and supplemented by Decree No. 54/2026/ND-CP and Decree No. 136/2026/ND-CP.

Regarding housing conditions, cases where there is no house owned by themselves are determined when the applicant and the spouse do not have housing information in the Certificate of Land Use Rights in the locality where the social housing project is located.
In addition, cases where there is already a house but the average area is less than 15 m2 of floor space/person may also be considered.
Regarding income conditions, current law stipulates that if the applicant is married, the total average monthly actual income of the couple does not exceed 50 million VND. The time to determine income is within 12 consecutive months up to the time of confirmation.
Notably, in the case of low-income people but without labor contracts, the law still allows them to participate in social housing policies if they meet income conditions. At that time, the commune-level police agency where they reside will carry out information confirmation according to regulations.
According to current regulations, raising children with disabilities is not a separate condition to be able to buy social housing. However, groups of people with disabilities and women are prioritized when considering if they have the same standards and conditions as other cases.
The Ministry of Construction said that people with low incomes in urban areas, if they meet the conditions for housing and income, can register to buy or rent social housing according to current regulations.
