On the morning of November 4, continuing the program of the 10th Session, the National Assembly listened to reports and reviewed a number of draft laws.
The submission of the Construction Law (amended) presented by Minister of Construction Tran Hong Minh said that the development of the Law project aims to continue to create favorable conditions, transparency, and equality for people and businesses; overcome limitations and shortcomings in the practice of construction investment; ensure the consistency and unity of the legal system.
Accordingly, the Construction Law (amended) consists of 8 chapters and 97 articles (a decrease of 71 articles compared to the current one).
The Minister of Construction said that when amending the law, the drafting agency focused on innovating methods, improving the effectiveness of construction investment management, reducing administrative procedures, and business investment.
According to the draft, the regulations on granting construction permits are amended in the direction of expanding the subjects of exemption and simplifying procedures. The Government proposes to issue construction permits online, minimizing the issuance time - expected to be at most 7 days.
Currently, the time for granting this license for individual houses is 15 days, for works (not individual houses) is 20 days and for works of level I and II is not more than 30 days from receiving a complete and valid dossier.
Recently, many reflections show that administrative procedures in the construction sector are still cumbersome, prolonged and expensive, although many resolutions have been issued to reduce administrative procedures. Faced with this situation, Prime Minister Pham Minh Chinh has repeatedly directed to reduce construction licensing procedures and strengthen post-inspections.
Also according to the draft law, projects that have been assessed by a construction expert agency and feasibility study report can be exempted from construction permits. The Government also proposes the principle that from preparation to start construction, there is only one control (1 administrative procedure) for each project and project.
The draft law also adds regulations on information systems, national databases on construction activities to identify works, shortened procedures for special public investment projects...

Reviewing this content, Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai said that the amended regulations in the draft law are feasible, but the assignment of many specialized regulatory agencies can lead to overlap and conflict between sub-law documents.
Regarding the issuance of construction permits, Ms. Nguyen Thanh Hai said that the permits are not barriers but tools to protect rights and social order because the issue lies in the quality and licensing process.
Therefore, the inspection agency recommends that the drafting agency - Ministry of Construction study and simplify the process, clearly defining responsibilities, processing deadlines and publicizing information for people and businesses to monitor.
At the same time, the drafting agency also needs to add a mechanism for handling violations with licensed works but constructed in violation of the design, changing the function.
The Committee for Science, Technology and Environment also suggested that the Ministry of Construction study quality management, acceptance, and handover of works in the direction of "doing well from the beginning", shifting from inspection to quality prevention and control throughout the survey, design, construction and maintenance process.
