The Ho Chi Minh City Department of Construction has just submitted to the Ho Chi Minh City People's Committee on implementing the direction of the Chairman of the Ho Chi Minh City People's Committee to implement the Prime Minister's Official Dispatch No. 78 on cutting and simplifying administrative procedures in the construction sector and exempting construction permits.
In particular, the Department of Construction said that through the first review of 356 projects with low-rise housing with detailed planning at a scale of 1/500 approved or agreed upon by competent state agencies according to regulations (with a total of about 55,000 houses).
Of the 356 projects mentioned above, 112 projects are eligible for exemption from construction permits according to current construction laws. In particular, the architectural planning indicators are determined in the decision approving the detailed planning at a scale of 1/500 (or the overall planning at a scale of 1/500 and the approved architectural plan of the project), regulations on management according to the detailed planning project at a scale of 1/500, approved house models and other relevant legal documents.
Therefore, the Department of Construction proposed that the City People's Committee approve the delegation of the first phase of implementing the reduction of procedures for granting licenses for the construction of individual houses in areas with detailed planning at a scale of 1/500.
According to the proposal, the Department of Construction will announce a list of 112 projects that are eligible for exemption from construction permits according to regulations. At the same time, the Department of Construction was assigned to organize an inspection of the implementation and guide the People's Committees of wards and communes to resolve difficulties and problems arising during the implementation process.
This agency also proposed that the City assign the People's Committees of wards and communes to publicly post the list of projects that are eligible for exemption from construction permits, detailed plans at a scale of 1/500 (or general plans at a scale of 1/500 and architectural plans of works) approved or approved by competent state agencies according to regulations.
In addition, instruct individuals and organizations to comply with the detailed planning at a scale of 1/500 (or the master plan at a scale of 1/500 and the architectural plan of the project) approved or approved in accordance with regulations and comply with legal regulations on construction start when receiving notification of the start date...
Previously, implementing the direction from the Prime Minister's Official Dispatch 78, Chairman of the Ho Chi Minh City People's Committee Nguyen Van Duoc directed competent agencies to advise on the implementation of focusing on cutting and simplifying administrative procedures in the construction sector, and promptly specifying the Prime Minister's direction on cutting construction licensing procedures in the city.
The city has requested the Department of Construction to advise the city's leaders to issue documents guiding areas that have clear regulations, based on the alley boundary and housing construction architecture stipulated in the architectural management regulations in Ho Chi Minh City, people do not ask for permission to build houses but only need to register.
On that basis, the Department of Construction has also developed a pilot project to exempt construction permits and reduce procedures.
After July 1, the Department of Construction proposed that the city assign a department to continue coordinating with the People's Committees of communes and wards to review and continue to announce projects with detailed plans 1/500 (or general plans at a scale of 1/500 and construction architectural plans) that have been approved or approved and are eligible for exemption from construction permits according to regulations.
This agency also requested the City People's Committee to report to the Prime Minister and the Ministry of Construction to allow Ho Chi Minh City to pilot "Exemption from construction permits for individual houses with a scale of less than 7 floors in areas with detailed planning 1/500, or urban designs approved by competent State agencies in accordance with regulations".
