On the Government Portal, Ms. H.V.A expressed that she is a sales employee at a company in Hanoi, with an average monthly income of less than 15 million VND. However, there are months when her income increases to 17 million VND (including hard salary and business salary), there are months when she only receives a hard salary of 8 million VND.
Ms. V.A asked, do you have enough income to buy social housing according to regulations?
The Ministry of Construction responds to this issue as follows:
The 2023 Housing Law has specifically stipulated the beneficiaries of social housing support policies.
Social housing buyers who are eligible for housing support policies must meet housing conditions and income conditions (in Articles 29 and 30 of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing).
Clause 1, Article 30 of Decree No. 100/2024/ND-CP stipulates:
"For subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, the following income conditions must be ensured:
In case the petitioner is a single person, the actual monthly income must not exceed 15 million VND as calculated in the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works. In case the plaintiff is married according to the provisions of law, the plaintiff and his/her husband (husband) with a total monthly income shall receive no more than 30 million VND in salary according to the Salary Table, confirmed by the agency, unit, or enterprise where the subject works.
The time to determine income conditions for 1 consecutive year, starting from the time the subject specified in this clause submits a valid dossier to the investor to register to buy or rent-purchase social housing.
Based on the above regulations, the condition for income to buy social housing is to have a real monthly income according to the salary table, salary not exceeding 15 million for single people. In case of marriage, the income of the single person and the wife (husband) must not exceed 30 million for 01 consecutive year from the time the person in need submits the application for social housing purchase to the investor.
