Based on Clause 1, Article 77 of the 2023 Housing Law, regulations on subjects eligible for support in resolving the sale, lease-purchase, and lease of social housing are as follows:
Article 77. Form of implementation of social housing support policies
1. Support in resolving the sale, lease-purchase, and lease of social housing for subjects specified in Clauses 1, 4, 5, 6, 8, 9 and 10 of Article 76 of this Law; subjects specified in Clause 7, Article 76 of this Law who are not yet entitled to housing support policies for the people's armed forces.
Based on local conditions, the Provincial People's Committee may stipulate the support for resolving the sale, lease-purchase, and lease of social housing for subjects specified in Clauses 2 and 3, Article 76 of this Law.
Thus, civil servants who are eligible for social housing purchase support meet the following conditions:
Housing conditions
According to Article 29 of Decree 100/2024/ND-CP (amended and supplemented in Decree 54/2026/ND-CP) stipulating housing conditions as follows:
- In case there is no housing owned by them, it is determined when the subject specified in Clause 1, Article 77 of the 2023 Housing Law and the spouse of that subject (if any) are determined to have no name or no housing information content in the Certificate of land use rights, ownership of assets attached to land in the province or centrally-run city where the social housing project is located.
Within 7 days from the date of receiving the request for confirmation of housing conditions, the competent authority issuing the Certificate of land use rights, ownership of assets attached to land according to the provisions of land law in the province or centrally-run city where there is a social housing project certified according to the provisions of this clause.
- In case the subject specified in Clause 1, Article 77 of the 2023 Housing Law owns a house but the average housing area per capita is less than 15 m2 of floor space/person. The average housing area per capita specified in this clause is determined on the basis of including: the applicant, the spouse of that person, the father, mother (if any) and children of that person (if any) registered permanently residing in that house.
In addition, Clause 2, Article 9 of Resolution 201/2025/QH15 (effective from June 1, 2025) stipulates that in cases where subjects entitled to social housing support policies according to the provisions of the law on housing have a workplace far from their residence, the housing condition for being able to buy or lease-purchase social housing is that they have not been able to buy or lease-purchase social housing, do not have housing owned by them, or have housing owned by them but far from their workplace. Based on the actual conditions of the locality, the Provincial People's Committee shall specify the cases of having housing owned by them but far from their workplace entitled to social housing support policies.
Conditions on income
Based on Article 30 of Decree 100/2024/ND-CP amended and supplemented in Decree 54/2026/ND-CP and Decree 261/2025/ND-CP stipulating the conditions on income as follows:
(1) For subjects specified in Clauses 5, 6 and 8, Article 76 of the 2023 Housing Law, the following income conditions must be ensured:
(i) In case the applicant is a non-married person or is certified as single, the average monthly actual income does not exceed 20 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
In case the applicant is a non-married person or is certified as single and is raising a minor child, the average monthly actual income does not exceed 30 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
(ii) In case the applicant is married according to the provisions of law, the applicant and their spouse have a total average monthly actual income of no more than 40 million VND/month calculated according to the Salary and Wages Table certified by the agency, unit, or business where the subject works.
Thus, cadres and civil servants, even if they already have a house, can still be considered for social housing purchase if they meet the conditions on income and current residence far from workplace.
