Chairman of Hanoi People's Committee Vu Dai Thang has just signed and issued Decision No. 37/2026/QD-UBND on promulgating Regulations on criteria for homeowners and land users who are recovered when implementing urban renovation and embellishment projects to buy, lease, and lease-purchase social housing according to specific cases in Hanoi City.
This Decision details the criteria for homeowners and land users who are recovered when implementing urban renovation and embellishment projects to purchase, lease, or lease-purchase social housing in social housing construction projects according to the provisions of Clauses 3 and 4, Article 6 of Resolution No. 69/2025/NQ-HĐND stipulating a number of policies on compensation, support, and resettlement when implementing urban renovation and embellishment projects; renovation and reconstruction of apartment buildings (urban renovation and embellishment projects), amended and supplemented in Clauses 1 and 2, Article 1 of Resolution No. 89/2025/NQ-HĐND.
Subjects eligible for purchase, lease, and lease-purchase of social housing at social housing construction projects that are not subject to lottery and do not meet the following conditions include: House owners, land users whose land is recovered to implement urban renovation and embellishment projects who are eligible for resettlement to serve site clearance but do not need to buy resettlement houses (regulated in Clause 3, Article 6 of Resolution No. 69/2025/NQ-HDND, amended in Clause 1, Article 1 of Resolution No. 89/2025/NQ-HDND).
House owners and land users who are recovered to implement urban renovation and embellishment projects but do not meet the conditions for resettlement arrangement, have housing difficulties (regulated in Clause 4, Article 6 of Resolution No. 69/2025/NQ-HDND supplemented in Clause 2, Article 1 of Resolution No. 89/2025/NQ-HDND).
The subjects mentioned above in this regulation are eligible to purchase, lease, or lease-purchase social housing and must simultaneously meet the following criteria:
Having a document from the People's Committee of the commune or ward (Commune-level People's Committee) where the urban renovation and embellishment project is located confirming that they are the subjects specified in Clause 1 or Clause 2, Article 4 of this Regulation and wish to choose one of the forms: purchase, lease, lease-purchase social housing.
Have not been allowed to buy or lease social housing at social housing construction investment projects in Hanoi City.
Belonging to one of the following cases: Having the entire area of land currently being recovered at the site clearance address (including cases of not recovering all and the remaining residential land area of the land plot after recovery is smaller than the minimum area allowed for land plot separation in the locality) and households and individuals who no longer have residential land or other houses in the commune level area where the land is recovered.
Not being completely recovered of the land area, the remaining area is eligible for existence, not being considered for resettlement but having a large number of people (larger than 7 people) or many households (from 2 couples or more) actually cohabiting on one land plot at the land clearance address and having an average housing area per capita less than or equal to the average housing area per capita according to the Government's regulations at the time of having documents according to the provisions in Clause 1 of this Article.
In case not belonging to points a and b of this clause but not living at the land clearance address and having other houses in the commune level area where the land is recovered, the average housing area per capita is less than or equal to the average housing area per capita according to the Government's regulations at the time of having documents according to the provisions of Clause 1 of this Article.
This decision takes effect from April 10, 2026.
