This morning, November 13, continuing the 8th Session, Minister of Natural Resources and Environment Do Duc Duy, authorized by the Prime Minister, submitted to the National Assembly a draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
Examining the draft Resolution, Chairman of the Economic Committee Vu Hong Thanh said that many opinions said that the regulations on the types of land to be piloted were too broad, including rice-growing land, forest land, land used for national defense and security purposes... therefore, it was suggested to consider land specialized in rice cultivation and forest land.
The Economic Committee proposes to review, study and clarify the application of the pilot mechanism through agreements on receiving land use rights or having land use rights for the above-mentioned types of land; study and evaluate the application of the provisions of the draft Resolution to all cases of agreements on receiving land use rights or only to cases where the time of agreement on receiving land use rights is from the effective date of this Resolution.
In addition, the appraisal agency proposed to study the pilot conditions based on the time of receiving land use rights (or having land use rights) before and after the Resolution takes effect.
At the same time, it is proposed to study and supplement the principle of ensuring the stability of 3.5 million hectares of rice land, a stable forest cover rate of 42%, and strict control to ensure that land use purposes are not converted for rice land, special-use forest land, protective forest land, production forest land, national defense land, and security land with large areas.
Chairman Vu Hong Thanh said, the Economic Committee proposed to clarify the regulation "The Ministry of National Defense and the Ministry of Public Security approve the permission for real estate business organizations to receive the transfer of land use rights for national defense and security land areas" at Point d, Clause 2, Article 2 of the draft Resolution because national defense and security land have very strict planning, the regulation as in the draft Resolution leads to the understanding that it allows the transfer of national defense and security land to carry out commercial housing projects.
Regarding specific criteria, the Economic Committee proposed to clarify the basis for setting the criterion of not exceeding 30% of additional residential land area during the planning period; clarify whether 30% of additional residential land area during the planning period (compared to the current status of residential land use) includes the land area used for commercial housing projects as stipulated in the Land Law?
“Clarify the implementation principles for cases where there are many projects proposed for pilot implementation, especially in some localities where many projects are stuck, such as Hanoi and Ho Chi Minh City, and study and stipulate specific criteria for selecting pilot projects” – Mr. Vu Hong Thanh suggested.
The majority of opinions of the Economic Committee agreed with the 5-year pilot implementation period of the Resolution, and at the same time recommended that the National Assembly assign the Government to specify and guide the implementation of this Resolution to ensure feasibility and timeliness in the process of implementing the Resolution, according to the appraisal report.
Immediately after listening to the presentation and the review report, the National Assembly discussed in groups the above draft resolution.
