According to Decision No. 51/2024/QD-UBND of the People's Committee of Cao Bang province, there are 3 cases where individuals can be allocated land without auction in Cao Bang province, respectively individuals who are subjects specified in Points a, c and d of Clause 3, Article 124 of the 2024 Land Law.
To understand in detail, individuals who need to apply for land allocation need to have the police agency confirm their working location and time, and are working in the district where they are applying for land allocation.
These individuals also need the residential registration agency to confirm their permanent residence and duration of residence in the commune where they are applying for land allocation.
Individuals applying for land allocation must ensure that they do not or have not owned residential land or a house in Cao Bang province.
On the other hand, individuals applying for land allocation must ensure that they have never been allocated land by the State or enjoyed housing support policies according to the provisions of law in Cao Bang province.
The order and procedures for land allocation without auction of land use rights are also clearly stated in Decision No. 51/2024/QD-UBND.
Accordingly, within 3 days from the deadline for submitting land allocation application, the Commune People's Committee will establish a Land Allocation Approval Council.
Within 7 days from the date of establishment of the Review Council, the Council will be responsible for organizing a meeting to review the individual's profile according to the conditions within the commune level.
Within 5 days from the date of the meeting to review the application, the Chairman of the Review Council will announce the results of the individuals applying for land without auctioning the land use rights. The time to announce the results will be made public within 15 days.
The time for appraisal of land allocation dossiers without auction of land use rights for individuals will take place within 55 days from the date of public announcement of land allocation application results.
