What is land change registration?
Land change registration is a legal procedure to record changes related to land use rights and ownership of assets attached to land. This is a mandatory process when there are events that change the content recorded in the Certificate of land use rights, house ownership rights and other assets attached to land.
According to Article 23 of Decree 101/2024/ND-CP, some cases of land change registration must be issued with a new red book, including:
Transfer, donation, inheritance of land use rights.
Change of land use purpose.
Mortgage, mortgage cancellation of land use rights.
Issuance, re-issuance of Certificate.
Change the personal information of the land owner.
Change of land area due to re-measurement or consolidation or division of plots.
Procedure for registration of changes and issuance of new certificates
Submit application at the Land Registration Office or One-Stop Department as prescribed by the Provincial People's Committee.
Review and verify the accuracy of records and changes.
Announce the results of review and correction, update changes to land records and land database.
The State agency will issue a new Certificate.
Lawyer Truong Anh Tu (TAT Law Firm) said that land change registration is mandatory within 30 days from the date of change in land use rights or assets attached to land. If not done on time, land users may be subject to administrative penalties according to regulations.
In addition, note to ensure that the land is not in dispute, not seized for enforcement of judgment and not included in state planning, to avoid risks when transacting. When the land is in dispute, the land registration agency will temporarily suspend the processing of registration change applications, until there is a decision to resolve the dispute by the competent authority.
The lawyer also added that if the land is in the planning area but there is no decision to reclaim it, the land user still has the right to exercise rights such as transfer, donation, inheritance. In case there is a decision to reclaim, the procedure for registration of changes will not be carried out.
