Customers have difficulty choosing a home construction contractor

According to the reflection of dozens of customers sent to the Lao Dong newspaper, from October 2024, the investor of My Gia Urban Area Project - including Vinh Thai Urban Development Joint Stock Company and An Khanh House Investment Co., Ltd. - asked the land buyer to sign a rough construction contract with Tan Khanh Hoa Co., Ltd.

Customers believe that this is a violation of the signed contract. Specifically, according to the sales contract, buyers have the right to choose the contractor and sign the construction appendix with the contractor they designate, as long as they meet legal and capacity requirements.

Ms. Bien Cam Anh - a customer at package 7 of My Gia urban area - said that she had proposed a contractor who had constructed many houses in My Gia Urban Area, but was rejected by the investor for lack of capacity.

Ms. Cam Anh has submitted a petition to clarify the legality of the investor's issuance of a construction process for low-rise housing... However, up to now, the investor's representative has not responded to Ms. Cam Anh.

Not only forced to choose a contractor, many customers also said they had to buy old designs for nearly 40 million VND.

If you want to adjust, customers must pay 25 million VND for adjustments that do not affect the structure; pay an additional 50 million VND for adjustments affecting the structure.

Although the investor had to pay for this design adjustment, he did not commit to being able to complete the design if the design was changed.

Ms. Le Thi Kim Ngan - a customer who bought package 7 of My Gia urban area also added that in March 2025, she signed a contract, notarizing the sale contract.

However, the entire contract has not been confirmed by the investor. The reason is that Ms. Ngan did not agree with some regulations set by the investor such as having to build a house within about 1 month. If not built, all penalty decisions of the investor must be accepted.

When Ms. Ngan asked what regulations were used to impose the penalty, the real estate department staff could not answer.

The contract content is not in accordance with the prescribed form

In response to the petition of customers with a house sale contract at the My Gia Urban Area project (packages 2, 7A and 8), the Department of Construction of Khanh Hoa province had a working session with the parties in March 2025.

Accordingly, the Department of Construction has requested Vinh Thai Urban Development Joint Stock Company to provide documents such as receipts, invoices related to payment for land purchase; contracts and capacity documents of the supervisory unit; internal procedures for collecting money for house design, repair costs after house design.

Also at the meeting, An Khanh Housing Investment Company Limited said that it will report in writing to the Department of Construction on the basis of legal regulations to issue related procedures.

Talking to Lao Dong, a representative of the Project Management Board of Vinh Thai Urban Development Joint Stock Company said that for customers' recommendations, investors have met and discussed. The contents that the investor has put forward are all complied with according to the house sale and purchase contract signed with the customer.

The representative of Khanh Hoa Department of Construction assessed that the content agreement between customers and the investor is a civil matter. Through inspection, the Department of Construction detected contracts between the investor and the customer signed but did not guarantee the sample and the contents of the contract as prescribed by the State.

It is expected that the inspectorate will invite the investor and customers to work a second time because there are some issues arising above. After working with the parties, the department inspectorate will report the handling direction to the superiors.
