Transferring the case of " mistakenly building" nearly 50 houses on other people's land to Ho Chi Minh City Police

HCMC - The Ho Chi Minh City Party Committee's Internal Affairs Committee has transferred the complaint about the mistaken construction of 50 houses on agricultural land to the Ho Chi Minh City Police.

On October 30, the authorities said that the Ho Chi Minh City Party Committee's Internal Affairs Committee had transferred the petition of Mr. Truong Minh Ky (residing in An Phu Ward, Ho Chi Minh City) to the Ho Chi Minh City Police. The Ho Chi Minh City Party Committee's Internal Affairs Committee requested the Ho Chi Minh City Police to consider and resolve the matter in accordance with the provisions of law and notify the results of the settlement to the City Party Committee's Internal Affairs Committee.

This is a long-term complicated lawsuit by Mr. Truong Minh Ky against Mr. L.V.H and some people who built houses by mistake on the perennial land plot No. 87 (large 5,802 m2) on map sheet No. 16, Tan Khanh ward (formerly Tan Phuoc Khanh ward, Tan Uyen city, Binh Duong province). This plot of land has been granted a legal land use right certificate to Mr. Ky since 1999.

In 2017, Mr. Ky discovered that Mr. L.V.H and some people had mistakenly built a house on his plot of land. After that, Mr. Ky went to report and filed a lawsuit to reclaim the land.

The case was brought to trial by the People's Court of Tan Uyen City and forced those who illegally built on the land to demolish the house and return the land to the plaintiff, Mr. Ky. The defendant then appealed, through many levels of trial but all of the petitions were rejected, and at the same time, Mr. Ky's legal ownership of the land was recognized.

However, the individuals involved did not comply, continuing to complete the construction of 47 townhouses for sale to people and 1 boarding house.

At the time of resolving the land use rights dispute for the plaintiff, Mr. Truong Minh Ky, in addition to forcing Mr. L.V.H and other related people to return the land, the People's Court of Tan Uyen (old) considered there were signs of violating criminal law in the case, so it recommended that the police investigate.

In mid-May 2025, the Investigation Police Agency of Binh Duong Province Police (formerly Ho Chi Minh City Police) sent a document requesting the People's Committee of Tan Phuoc Khanh Ward (now Tan Khanh Ward, Ho Chi Minh City) to coordinate and provide records and documents related to the property fraud case committed by Mr. L.V.H.

However, after Binh Duong merged into Ho Chi Minh City, the matter temporarily subsided. Mr. Truong Minh Ky was worried that the merger would affect the settlement of the case, so he continued to send a complaint to the Ho Chi Minh City authorities.

On October 30, the reporter noted that nearly 50 townhouses and a row of boarding houses built on land belonging to others in Tan Khanh ward, Ho Chi Minh City are still intact. At the entrance, there is a notice board from the ward with the content that the house and land are in dispute, built without permission, and prohibited transactions of buying, selling, and transferring.
