On the morning of October 28, speaking with Lao Dong, Ms. Tran Thi Kim Loan said that after not being able to agree on the plan to buy back the mistakenly built plot of land, Mr. Do Van Huu will have to move the house to his plot of land in the next few days.
According to Ms. Loan, following the mobilization of the local government as well as his family, Mr. Huu wished to buy back the land that was built by mistake (owned by Ms. Loan and her husband). However, Mr. Huu had promised that he would have enough money in 1-2 months, so Ms. Loan did not agree and asked Mr. Huu to move the house to restore the land to its original state.
Mr. Huu's family also decided to rent a workshop to move the house. It is expected that today, October 28, the "genie" team will return to carry out related work.
The content of the case is that since September 2024, Ms. Tran Thi Kim Loan and her husband have received the transfer of land use rights with an area of 60 m2 at plot No. 4856, map sheet No. 03 issued by the People's Committee of Thuy Nguyen district, Hai Phong city (old) on October 19, 2024. However, on November 12, 2024, when Ms. Loan's family came to inspect, they suddenly saw that the land was being occupied by Mr. Do Van Huu's family to build a 2-storey house.
Mr. Do Van Huu said that the construction of a house on the land of Ms. Tran Thi Kim Loan was due to a mistake, because Mr. Do Van Huu's family also bought a plot of land, 4 plots from the location of this plot. The People's Committee of the commune has repeatedly requested to stop construction at the wrong location. However, Mr. Huu's family still deliberately continues to build and complete the house. Therefore, Ms. Loan and her husband filed a lawsuit.
The People's Court of Region I - Hai Phong held a first-instance trial of the case, forcing Mr. Do Van Huu to move all his belongings, dismantle all construction works on the land, and return them to Ms. Tran Thi Kim Loan and her husband.
According to Mr. Huu, in 2024, his family had no place to eat or live, so they asked a woman named N.T.H (in the same locality) to buy a small piece of land to build a house. In August 2024, this woman informed Mr. Huu about someone selling a 60 m2 plot of land in village 7 for 550 million VND, including taxes and fees according to regulations.
Immediately afterwards, Ms. N.T.H transferred 50 million VND as a deposit to buy the land to the land owner. Mr. Huu said that due to lack of housing and lack of legal knowledge, he immediately broke ground after depositing the money and built a house on lot No. 2 from the beginning of the alley (current location of the house built incorrectly).
At the end of September 2024, a group of people came to inform Mr. Huu that they had mistakenly built a house on the land of Ms. Tran Thi Kim Loan, who had deposited to buy it. On November 18, 2024, the People's Committee of Kien Bai commune invited Mr. Huu to work with the reason that he had mistakenly built a house on the land of Ms. Tran Thi Kim Loan.
