Many people working in Hanoi are forced to move because they live near a house under construction in an alley.

Talking to Lao Dong reporter, Ms. Nguyen Thu Thuy (renting a room in alley 5 Phu My, Nam Tu Liem district, Hanoi) shared that for the past month, she has been unable to sleep, her daily life has been disrupted by the noise of the house construction in the narrow alley from early morning to midnight.

Ms. Thuy shared that to avoid the noise of the construction site, she looked for a room 3km away from her workplace and negotiated with the landlord to move this month.

"The construction project lasted almost day and night, so I didn't dare open the door of my rented room for fear of dust and noise. Even though my contract hadn't expired yet, I negotiated with the landlord to move out at the end of October," said Ms. Thuy.

Similarly, Ms. Tran Thi Nguyet Nga (living in Cau Giay district, Hanoi) confided that the alleys in Hanoi are inherently narrow, so when households repair or rebuild their houses, they face many difficulties.

According to Ms. Nguyet Nga, not only is there dust, many construction sites also carry out construction, transport construction materials, and drive piles loudly at midnight and early morning, making many residents extremely upset.

Referring to this content, lawyer Quach Thanh Luc - Hanoi Bar Association - said that the Construction Law and guiding decrees do not have any provisions prohibiting construction at night. Therefore, it is impossible to apply sanctions in the construction sector.

However, sanctions can only be applied according to Decree 144/2021/ND-CP of the Government on penalties for noise pollution in residential areas from 10:00 p.m. to 5:00 a.m.

Accordingly, in case of exceeding technical standards on noise by less than 02 dBA, the penalty applied is a warning.

In case of noise-causing behavior exceeding the technical standard by 02 dBA or more, depending on the level of noise pollution, the applicable penalty will be a fine from 1 million VND to 160 million VND, based on the provisions of Article 22, Decree No. 45/2022/ND-CP of the Government.

The heaviest penalty applies if the noise is determined to exceed technical standards by 40 dBA or more.

At that time, the fine will be from 140-160 million VND, and the facility's operations will be suspended for 6 to 12 months.
