Pursuant to Point b, Clause 2, Article 18 of Decree 16/2022/ND-CP, violating regulations on construction acceptance specifically for projects that have been accepted but do not ensure the quality of the project can be punished as follows:
Article 18. Violating regulations on construction acceptance
1. Fine from VND 20,000,000 to VND 40,000,000 for one of the following acts:
a) Confiscation of fees not in accordance with prescribed procedures and order.
b) Not sending a document to a specialized construction agency requesting an inspection of the acceptance work according to regulations.
2. Fines from VND 80,000,000 to VND 100,000,000 for the act of putting the construction part, construction items, and construction works into use without organizing acceptance according to regulations.
3. Fine from VND 100,000,000 to VND 120,000,000 for one of the following acts:
a) Confiscation when the workload has not been completed or the acceptance volume is greater than the actual completed volume for works using public investment capital, foreign state capital for public investment, and PPP projects.
b) The project has been accepted but does not ensure the quality of the project.
4. Remedial measures:
a) Forced within 10 days from the date of issuance of the decision to sanction administrative violations, the investor must have a written request to the competent authority to inspect the collection work according to the provisions of Point b, Clause 1 of this Article.
b) Forced within 1 month to 3 months, the investor must organize the acceptance of the part of the project or the project items that have been put into use with the act prescribed in Clause 2 of this Article.
c) Forced to organize the collection according to the actual construction and forced to recover the amount of money that has been accepted and incorrectly paid to the investor's account for the act specified in Point a, Clause 3 of this Article.
d) Forced to remedy the quality of the work in accordance with the provisions of the acts specified in Point b, Clause 3 of this Article.
Thus, for projects that have been accepted but do not ensure the quality of the project, a fine of 100 million to 120 million VND can be imposed. In addition, the quality of the project must be restored in accordance with regulations.
Note: The above fine level applies to organizations. The fine for individuals is 1/2 of the fine for organizations committing the same administrative violation. (Clause 3, Article 4 of Decree 16/2022/ND-CP).
