Illegal construction on agricultural land
Recently, Mr. Tuan, a land investor, has been following brokers to the suburbs of Hanoi to buy agricultural land plots, taking advantage of the opportunity to expand the land use right transfer limit.
Most recently, Mr. Tuan was taken by a "land broker" to see an agricultural land plot, over 100 square meters wide on Quang Tien Street, Tay Mo Ward, Hanoi City, for sale at over 2 billion VND.
The land is more than 5m wide and 20m long, located close to Quang Tien Street, near the new urban area of Tay Mo Ward and Aeonmall Ha Dong supermarket, and is assessed to have quite good profit potential.
"Buying this agricultural land plot can be used as a factory, or building a boarding house for rent, which is very potential," said a land broker named Ha (character's name has been changed).
Recently, the Hanoi People's Committee has issued many documents requesting People's Committees at all levels to review and count violations of construction order and violations on agricultural land in previous stages to thoroughly handle them; regularly closely coordinate in inspection and examination work, promptly detect and resolutely handle violations.
Many communes and wards in Hanoi have also actively taken action to handle violations on agricultural land. Typically, on December 23, Hat Mon commune, Hanoi City, enforced the demolition of 10 construction works on agricultural land.

The violations are located in Dong Mieu, Doc Cai, Bai Gia areas in Tao 1, Tao 2, Tao 3 villages, related to 5 plots of land illegally used by Mr. Tran Hoc Thai, Ho Huu Duc, Phan Dinh Thanh, Do Duy Thang and Phan Dinh Kham households to build works on agricultural land.
According to the People's Committee of Hat Mon commune, the enforcement is to strictly maintain legal discipline in the field of land management and use in the commune, resolutely handle cases of intentional non-compliance according to the provisions of law, in order to restore order and order, enhance the effectiveness of the state in land management and use, prevent and strictly handle violations and re-violations in the land sector.
At the same time, ensure compliance with legal regulations, maintain stable security and order in the locality before, during and after enforcement. Ensure the safety of people and vehicles participating in enforcement, prepare plans to handle possible situations; resolutely handle cases of law violations, disorder, obstruction, resistance to law enforcement officers, and property destruction during enforcement.
Need to be handled thoroughly
Dr. Nguyen Minh Phong - Former Head of Economic Research Department, Hanoi Institute for Socio-Economic Development Research said that to prevent loss of land resources, it is necessary to increase the publicity of land use planning nationwide;
At the same time, continue to remove difficulties and obstacles in mechanisms and policies related to land auctions. In addition, land valuation needs to closely follow market prices, associated with land use planning.
Lawyer Bui Dinh Ung - Hanoi Bar Association said that the Land Law clearly stipulates prohibited acts in the land sector, including not using land or using land for the wrong purpose, including agricultural land and public land.
"It is clear that using agricultural land, land under project planning, and public land for the wrong purpose is a violation of land law. Current legal regulations clearly stipulate the form of punishment for these acts, analyzed lawyer Bui Dinh Ung.
The Land Law stipulates the responsibility of Chairmen of People's Committees at all levels in detecting, preventing and handling violations of the law on land management and use.
Therefore, it is necessary to specify the responsibility of the locality and the responsibility of the head where the land law violation occurred" - lawyer Bui Dinh Ung said and emphasized that this is one of the important solutions to protect agricultural land and project planning land from being used for the wrong purpose.
In addition to strengthening management, supervision and sanctions, lawyers said that perfecting the law and improving the capacity of the team of officials working in land management is also a solution that needs to be focused on.
In addition, it is necessary to apply information technology to land management to enhance transparency, efficiency and reduce corruption and negativity.
