Many violating projects are handled
Over the past time, in Hanoi, construction order management has had many positive changes, especially since the implementation of the 2-level local government model. Thanks to that, the situation of illegal construction and unlicensed construction on public land and agricultural land has been gradually curbed and clearly improved.
However, besides the achieved results, the management of construction order in some wards and communes still has limitations, causing functional forces to take strong action.
Recently, on January 28, Thanh Liet Ward People's Committee, Hanoi City organized a campaign to enforce 3 construction projects violating construction order on agricultural land.
The three projects forced to be demolished include the project invested by Mr. Nguyen Van Toan at No. 34, alley 18 Luong Ngoc Quyen, which is a steel frame and column project, with an average height of about 3.3 m, corrugated iron roof, corrugated iron surrounding, with a construction area of about 19.711 m2;
The project is invested by Ms. Nguyen Thi Tam at No. 08B, lane 20, alley 214 Nguyen Xien street, is under construction, has a steel frame and columns about 3.5 m high; red-lined brick walls, lightweight concrete panels placed above, corrugated iron roof, corrugated iron surrounding, with a construction area of about 26.46 m2;
The project invested by Mr. Pham Van Toan at No. 58, alley 475/20 Nguyen Trai street, Thanh Liet ward, has constructed the 1st floor with 8 reinforced concrete columns about 3.3 m high, red-lined brick walls 110 mm thick, construction area of about 31.49 m2. By the time of enforcement, the project had formed a frame, reinforced concrete columns and concrete roofs up to 4 floors, seriously violating regulations on agricultural land use and construction order.
According to Thanh Liet Ward People's Committee, the above works are all illegally built on agricultural land, without being licensed by competent authorities.
To ensure that the enforcement is carried out seriously and in accordance with legal regulations, the Ward People's Committee has developed a detailed plan, mobilizing nearly 50 officers, soldiers and functional forces to participate. Preparation work has been deployed synchronously and thoroughly from reviewing legal documents, surveying the current status of the project to developing plans to ensure security and order, safety for participating forces and people in the enforcement area.



The People's Committee of Chuyen My commune, Hanoi City, also organized forces to implement a plan to enforce and handle violations and enforce land recovery for the household of Ms. Nguyen Thi Hue, to serve the site clearance for the project to upgrade provincial road 428A, the section from Cong Than bridge to Cau Gie bridge, passing through Gie Ha village, Chuyen My commune.
According to the People's Committee of Chuyen My commune, Ms. Nguyen Thi Hue's household, residing in Gie Ha village, committed violations when pouring the foundation within the protection scope of the Duy Tien river irrigation project with an area of about 120m2, the foundation height of about 5m; and at the same time gathered many items in the violating area.
Not only handling violations against the household of Ms. Nguyen Thi Hue, previously, the People's Committee of Chuyen My commune also developed a plan to handle violations, organized propaganda and mobilization for the household of Ms. Pham Thi Huyen, residing in Co Chau village.
Through many rounds of propaganda and mobilization, Ms. Pham Thi Huyen's household has clearly recognized the violations and voluntarily dismantled illegal construction works on public land managed by Chuyen My Commune People's Committee.
Strictly handle violations from the beginning
Talking to Lao Dong Newspaper, Assoc. Prof. Dr. Bui Thi An - Deputy Chairman of the Economic Advisory Council (Vietnam Fatherland Front Committee of Hanoi City) said that, with the specific and sensitive nature of agricultural land use, functional agencies need to carefully consider management solutions, in order to both promote development and avoid abuse, causing loss of the precious agricultural land fund of the Capital.
To make urban construction order management more effective, Ms. An believes that functional forces need to strengthen patrols and inspections, promptly detect and strictly handle violations right from the time they arise. Handling needs to ensure timeliness in preparing dossiers, and at the same time must be thorough in the implementation stage.
According to Assoc. Prof. Dr. Bui Thi An, the process of preparing violation dossiers needs to be carried out quickly and transparently; in particular, there must be coercive measures to thoroughly dismantle the violating part of the project, in accordance with the requirement to restore the original state. If there are no strong and decisive coercive measures, the commitments of the investor or project owner will only stop on paper.
It is time for all levels of government to turn the commitments of "resolute handling" into specific actions, thoroughly dismantling violating works.
