Users may be fined if they use the apartment for the wrong purpose.

Pursuant to Clause 3, Article 2 of the 2023 Housing Law, apartment buildings are divided into two types as follows:

- Apartment buildings are built for residential purposes.

- Apartment buildings are built for mixed-use purposes, both for living and business.

In addition, according to Point c, Clause 8, Article 3 of the 2023 Housing Law, apartments cannot be used for other purposes such as office buildings or company headquarters.

In addition, according to the provisions of Point e, Clause 1, Article 70 of Decree 16/2022/ND-CP:

Article 70. Violating regulations on management of apartment use for apartment building users

1. Fine from VND 20,000,000 to VND 40,000,000 for one of the following acts:

e) Using apartments for non-residential purposes.

3. Remedial measures:

d) Forced use of apartments for residential purposes in accordance with the acts specified in Point e, Clause 1 of this Article.

In addition, according to Point c, Clause 3, Article 4 of Decree 16/2022/ND-CP, the above is the fine for individuals, the fine for organizations is twice the fine for individuals, and business activities must be terminated at the apartment building.

The placement of the company headquarters in an apartment will be fined from 20 - 40 million VND for individual apartment owners or from 40 - 80 million VND for apartment owners of organizations.
