The Ministry of Agriculture and Environment has drafted a law amending and supplementing a number of articles of the 2024 Land Law and is seeking opinions. In the draft, the Ministry of Agriculture and Environment proposed to amend and supplement Point d, Clause 2, Article 257 of the 2024 Land Law in the direction of removing the regulation on additional land use fees payable for the period not yet included in land use fees and land rents.
Currently, Point d, Clause 2, Article 257 of the current Land Law stipulates: The Government stipulates the application of land valuation methods and the amount of money that land users must pay supplementally for the period not yet included in land use fees and land rents for cases specified in Points a, b and c of this Clause.
The new draft proposes amendments as follows: The Government stipulates the application of land valuation methods in cases specified in Points a, b and c of this Clause.
Thus, compared to the current Law, the draft has removed the regulation on collecting additional land fees for the period not including land use fees and land rents.
Previously, in the draft amendment to Decree 103, the Ministry of Finance proposed an additional plan to reduce the land use fee collection rate to 3.6%/year instead of 5.4% or completely remove the additional collection regulation.
