1. Expanding beneficiaries of social housing support policies
According to Article 76 of the 2023 Housing Law, 2 groups of beneficiaries of social housing support policies have been amended and supplemented:
+ Students studying at universities, academies, colleges, vocational schools, and specialized schools as prescribed by law; students studying at public ethnic boarding schools.
+ Enterprises, cooperatives, and cooperative unions in industrial parks.
2. Expanding the principles of selling, leasing, buying, and renting social housing
According to Clause 4, Article 62 of the 2014 Housing Law, the lessee or buyer of social housing cannot resell the house for a minimum period of 5 years from the time of paying the entire rental fee and house purchase; in case within 5 years, from the date the buyer or lessee has paid the entire purchase fee and house purchase, and there is a need to sell this house, they can only resell it to the social housing management unit or sell it to subjects eligible to buy social housing if this unit does not buy at the maximum selling price equal to the selling price of the same type of social housing at the same location, time of sale and does not have to pay personal income tax.
Clause 1, Article 89 of the 2023 Housing Law stipulates: Social housing buyers are not allowed to resell their houses for a minimum period of 5 years from the date of full payment for the house purchase, except in the following cases:
Within 5 years from the date the buyer of the social housing has paid the full price for the house and has a need to sell this house, he/she can only resell it to the investor of the social housing construction investment project or resell it to the subject eligible to buy social housing at the maximum selling price equal to the selling price of this social housing in the sale and purchase contract with the investor of the social housing construction investment project. Personal income tax payment is implemented in accordance with the provisions of the law on tax.
Thus, according to the Housing Law 2023, buyers are allowed to resell to the investor of a social housing construction investment project instead of reselling to that social housing management unit.
Change the maximum selling price to this social housing sale price in the sale and purchase contract with the investor of the social housing construction investment project.
3. Income conditions to enjoy social housing support policies.
Pursuant to Point a, Clause 1, Article 30 of Decree 100/2024/ND-CP, for subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law 2023, including:
+ Low-income people in urban areas.
+ Workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks.
+ Cadres, civil servants, and public employees according to the provisions of law on cadres, civil servants, and public employees.
Accordingly, to enjoy social housing support policies, the above subjects must meet the following income conditions:
- Singles with actual monthly income will receive no more than 15 million VND as calculated in the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
- If a person is married according to the provisions of law, the person in a single relationship and his/her husband (husband) with a total actual monthly income will receive no more than 30 million VND as calculated in the Salary and Salary Table confirmed by the agency, unit, or enterprise where the subject works.
Note:
In case the subject is a low-income person in urban areas without a Labor Contract, if he/she is single, the actual monthly income received shall not exceed 15 million VND, if he/she is married according to the provisions of law, the single person and his/her husband/spouse with a total monthly income shall not exceed 30 million VND.
