Currently, Point a, Clause 1, Article 78 of the 2023 Housing Law stipulates housing conditions for those applying to buy social housing in 2025 as follows:
(1) The petitioner must not have a house of his/her own in the province where there is a social housing project.
(2) Not yet allowed to buy/rent-purchase social housing.
(3) Not yet entitled to any housing support policy in any form in the province where there is a social housing project.
(4) If there is a house in a province with a social housing project: That house must have an average area per capita of less than 15m2 of floor space/person.
(5) If eligible to rent public housing (stipulated in Points b, c, d, dd, e and g, Clause 1, Article 45 of the Housing Law 2023): Not allowed to live in public housing.
Thus, in case the candidate already has a house in the province where the project is located at the time of submitting the application, he/she will not be allowed to register to buy social housing anymore. However, in cases where a house is located but the average area per capita is less than 15m2 of floor space/person, it still meets the housing conditions according to regulations.
In addition to the above conditions, people also need to pay attention to the two housing conditions to be eligible to buy social housing mentioned in Article 29 of Decree 100/2024/ND-CP as follows:
- In case they do not have a house of their own: If they are married, both husband and wife cannot be listed in the red book/pink book in the province where there is a social housing project at the time of submitting the application for registration to buy or rent-purchase social housing.
- How to determine the average housing area per capita based on: The single parent, the person's wife (husband), father, mother (if any) and children of that person (if any) register to reside permanently in the house and then divide it.
- Place to submit an application to confirm the average housing area per capita: The People's Committee of the commune confirms within 7 working days.
Accordingly, only in cases where there is a house but the house is under 15m2 floor area/person can the person applying for social housing in the province where the project is located. If you already have a house at the time of applying, you cannot buy it anymore.
Note: Owning real estate in another province does not affect the conditions for buying social housing, because the law only requires the registered person to not have real estate at the time of submitting the application within the province or city where the project is located.
