Land used before December 18, 1980
People using land before December 18, 1980, if confirmed by the People's Committee at the commune level as not in dispute, will be considered for granting red books.
For land plots with houses or works serving life, if the area is equal to or larger than the recognized limit, the State will recognize residential land according to the correct limit and the land user will not have to pay land use fees.
For land plots with houses or works serving life, if the area is smaller than the residential land recognition limit, the entire plot of land is determined to be residential land and the land user does not have to pay land use fees.
For land plots used for non-agricultural production, business, trade and service purposes, the land area is recognized based on the actual area in use. Recognition is carried out as in the case of land allocation with land use fees, with a stable and long-term term of use.
Land used before October 15, 1993
In case the land plot is confirmed by the People's Committee at the commune level to be not in dispute, the land user will be considered for a red book.
For land with houses or works serving life: If the area is equal to or larger than the limit for recognizing residential land, the State recognizes residential land according to the correct limit, people do not have to pay land use fees.
If the area is smaller than the limit, the entire plot of land is determined to be residential land and no land use fee must be paid.
For land used for non-agricultural production, business, trade, and services, the area is recognized based on the actual area in use. The remaining area of the land plot will be determined according to the current status of use.
Land used before July 1, 2014
Up to now, if the People's Committee of the commune where the land is located confirms that there is no dispute, it will be considered for granting a red book:
For land plots with houses or works serving life, if the area is equal to or larger than the limit for land allocation in rural or urban areas, the State will recognize residential land according to the correct limit.
In case the land plot has a smaller area than the limit, the entire area will be recognized as residential land.
For land plots used for non-agricultural production, business, trade, and services, the land will be recognized as non-agricultural production facilities or commercial and service land according to regulations.
