Construction of many items contrary to planning for business
The Phan Dinh Phung residential area project, Quang Ngai City, now belonging to Cam Thanh ward, Nghia Lo ward, Quang Ngai province, has an area of 15.49 hectares, initially invested by the People's Committee of Quang Ngai City (old).
In 2009, the Chairman of the Provincial People's Committee adjusted the project investor to the Quang Ngai City (old) Land Development and Exploitation Center. The project was put up for auction with 15.49 hectares of land that had not been invested in infrastructure construction. Phat Dat Real Estate Development Joint Stock Company was the unit that won the land use right auction with a winning bid amount of 89.5 billion VND in 2010.
According to the land use right auction plan approved in Decision No. 3762/QD-UBND dated August 30, 2010 of the Chairman of Quang Ngai City People's Committee (old), the investment time to complete the technical infrastructure system of the entire land area is no more than 3 years, but from the time of winning the auction to now, it has been 15 years, the Company has not invested in construction and handed over full technical infrastructure to Quang Ngai City People's Committee (now Cam Thanh ward, Nghia Lo ward) to serve the essential needs of people in the project area and neighboring areas.

After winning the auction with a total area of more than 15.49ha, of which 19,381m2 was planned to be a green park serving the community, instead of completing and handing over to the government for management as committed, the investor only implemented about 60% of the area. According to reporters' records, the rest was exploited to make football fields, tennis courts and business projects for decades, completely contrary to the approved plan, not in accordance with the winning auction plan.
According to Mr. Hoang Ngo Khanh Phuc - Vice Chairman of Cam Thanh Ward People's Committee, for the flower and green tree garden item with an area of 19,381 m2, previously Quang Ngai City People's Committee (old) had documents requesting Phat Dat Real Estate Development Joint Stock Company to urgently invest in completing this park area according to the approved plan.
Ending the exploitation of this area for business purposes and handing over these items and some social infrastructure works under the project to the People's Committee of Quang Ngai City (old) for management, serving the entertainment needs of people in the area. However, since then, the Company has not implemented it.
Prolonged waiting, risk of land acquisition
According to Mr. Nguyen Van Dieu - Chief Inspector of Quang Ngai province, through inspection, it was shown that the fact that the People's Committee of Quang Ngai City (old) did not invest in infrastructure before organizing the auction was not in compliance with investment regulations. The People's Committee of Quang Ngai City (old) approving the starting price, auction plan, and auction results is not within its authority.
Phat Dat Real Estate Development Joint Stock Company has not completed the technical infrastructure system including flower gardens, fire prevention and fighting, traffic roads to hand over to Quang Ngai City People's Committee (old). Responsibility belongs to Quang Ngai City People's Committee (old) and Phat Dat Real Estate Development Joint Stock Company.
Also according to Mr. Nguyen Van Dieu, after organizing the inspection, the Provincial Inspectorate requested Phat Dat Real Estate Development Joint Stock Company to urgently implement construction for land plots with symbols CC1, CC2, CC3, CC4, CC5, CC6, CC7 (facilities, production, business) according to detailed plan 1/500 that has been approved and completed, handing over flower gardens - green trees - sports facilities, fire prevention and fighting, traffic roads.
In case the Company does not implement it, the Department of Agriculture and Environment shall preside over and coordinate with the People's Committees of Cam Thanh and Nghia Lo wards to be responsible for inspection and supervision. Advise the Provincial People's Committee to consider and recover land in case the Company does not implement it to hand it over to the locality to avoid wasting land resources.
According to Mr. Hoang Ngo Khanh Phuc - Vice Chairman of Cam Thanh Ward People's Committee, the approved 1/500 detailed plan, land plots with symbols CC1, CC2, CC4, CC5, CC6, CC7 are planned as public commercial service land to serve essential needs for people within the project area and neighboring areas. However, since winning the auction (15 years ago), these land plots have not been invested in construction to put the works into operation, causing land waste, dilapidation, and urban unsightliness in the area.
