The policy of allocating agricultural land without collecting land use fees has created a clear legal basis for millions of farming households to feel secure in farming and sticking to the fields.
Article 128 of the 2024 Land Law stipulates: The State allocates land without collecting land use fees in the following cases: 1. Households and individuals directly engaged in agricultural production are allocated land for agricultural purposes within the limits prescribed by the Government;...".
Accordingly, land users in the above group will not have to pay land use fees when the State allocates land within the limit, as long as there is direct confirmation of agricultural production.
Along with that, Article 129 stipulates the term of use of allocated agricultural land: Households and individuals allocated land by the State for agricultural purposes in the cases specified in Clause 1, Article 128 of this Law are allowed to use the land for a period of 50 years. After the deadline, if there is a need, they can continue to use the land for the allocated period in cases where they are not subject to land recovery as prescribed in Articles 79, 80 and 81 of this Law.
This policy clearly demonstrates the State's consistent viewpoint in protecting the legitimate rights of farmers. Not collecting land use fees helps reduce input costs, while encouraging stable and long-term agricultural production. The limit of agricultural land allocated will be regulated by the Government for each type of land and each ecological zone, ensuring fairness and suitability to agricultural reality.
The 2024 Land Law will be a solid legal support for tens of millions of farmers across the country. This is not only a continuation of the humanitarian policy over the past decades but also an important stepping stone for Vietnam's agriculture to develop more sustainably in the new period.
