The Handbook guiding state management in the land sector when implementing two-level local governance of the Department of Land Management stipulates requirements for combined land use for multiple purposes.
Requirements for combined land use for multiple purposes:
- Not changing the land type according to the prescribed land classification and the land type has been determined in the land use right documents according to regulations.
- Not losing the necessary conditions to return to land use for the main purpose.
- Does not affect national defense and security.
- Limit the impact on the conservation of natural ecosystems, biodiversity, and environmental landscapes.
- Does not affect the land use of adjacent plots of land.
- Fully fulfill financial obligations according to regulations.
- Comply with relevant laws.
Requirements on the scope of land use combined with multiple purposes:
- Using land for combined purposes not subject to land use purpose conversion.
- The area of land used for combined purposes does not exceed 50% of the land area used for the main purpose, except for the area of residential land used for multiple purposes.
- Construction works on agricultural land used for combined multi-purpose land must have appropriate scale and nature, making it easy to dismantle. The area of land used for construction works for combined purposes on rice-growing land and forestry land shall comply with the provisions of the Decree detailing rice-growing land and the law on forestry. Land with an unflooded water surface changes the flow, water surface area, and water level depth.
- The construction and renovation of works for combined purposes must comply with the provisions of the law on construction and other relevant laws.
- The time of land use for the combined purpose does not exceed the remaining land use term of the main purpose.
Condition for cases where public service units use land to build public works combined with trade and services, they must switch to leasing land with annual land rent payment for that combined area.
