Pursuant to Sub-section 1, Section C, Part V of the Appendix issued with Decree 151/2025/ND-CP, the procedures for land division and consolidation from July 1, 2025 are as follows:
(1) Land users submit a set of documents at the one-stop department at the provincial and commune levels; land registration office; branch of the land registration office. The dossier includes:
- Application for land division and consolidation according to Form No. 21 issued with Decree 151/2025/ND-CP;
- drawings of land division and consolidation made according to Form No. 22 issued with Decree 151/2025/ND-CP by the Land Registration Office, Branches of the Land Registration Office or by the measuring unit with a License on measurement activities and cadastral map establishment;
- The issued Certificate or a copy of the issued Certificate with the original for comparison or a notarized, certified copy;
- Documents of competent authorities showing the content of land division and consolidation (if any).
(2) The dossier receiving agency shall issue a dossier receipt and schedule a return of results to the dossier submitter.
In case the dossier receiving agency specified in the One-stop Department is the dossier, the dossier shall be transferred to the Land Registration Office, Branch of the Land Registration Office.
(3) The Land Registration Office or a Branch of the Land Registration Office checks the records and compares them as prescribed in Article 220 of the 2024 Land Law to determine the conditions for land division and consolidation; checks information about the land user, boundary, area, and type of land of the land plots on the archival records and records submitted by the land user and performs as follows:
- In case the dossier does not meet the conditions for land division or consolidation, within 3 working days from the date of receipt of the complete dossier, the Land Registration Office, the Branch of the Land Registration Office shall return the dossier to the land user and clearly notify the reason;
- In case the dossier is eligible for land division or consolidation but the issued Certificate does not have a land plot diagram or has a land plot diagram but the edges are missing or the area and edges are not unified, within 03 working days from the date of receipt of the complete dossier, the Land Registration Office, the Branch of the Land Registration Office will return the dossier and clearly notify the land user of the reason for registering land changes;
- In case the dossier is not specified in Point a and Point b, Section 1, Part I, within 5 working days from the date of receipt of the complete dossier, the Land Registration Office, the Branch of the Land Registration Office shall confirm that it is eligible for land division, land consolidation with information on the land plot in the Application for Proposal for Land division, land consolidation, and at the same time confirm the Land division and Land consolidation drawings to complete the registration procedures, issue a Certificate of land use rights and ownership of assets attached to land for plots of land after land division and consolidation, except in cases where the Land division and land consolidation drawings are carried out by the Land Registration Office, Branch of the Land Registration Office;
- Official information of land plots after division and consolidation is only established and adjusted to the cadastral map after the land user registers the change and is granted a Certificate of land use rights and ownership of assets attached to land for the land plot after division and consolidation.
(4) In case of land division or consolidation without changing the land user, the Land Registration Office, the Branch of the Land Registration Office shall issue corrections and updates on changes in land records and land database; issue Certificates of land use rights and ownership of assets attached to land for plots of land after division or consolidation; issue Certificates of land use rights and ownership of assets attached to land to the person granted.
In case of land division or land consolidation and there is a change in land user, the procedure for registering changes in land and assets attached to land shall be carried out according to regulations.
