Decree 151/2025/ND-CP stipulates the division of authority of local authorities at 2 levels, decentralization of authority, and delegation of authority in the land sector.
Clause 1, Article 5 of Decree 151/2025/ND-CP stipulates the authority of the People's Committee at the district level according to the provisions of the Land Law and transfers it to the Chairman of the People's Committee at the commune level for implementation, including the specific land price decision as prescribed in Clause 2, Article 91 of the Land Law.
Referring to the law, Clause 2, Article 91 of the 2024 Land Law stipulates: Compensation for land is carried out by allocating land with the same purpose of use as the recovered land type. In case there is no land for compensation, compensation will be made in cash according to the specific land price of the recovered land type decided by the People's Committee at the competent level at the time of approving the compensation, support and resettlement plan. In case the person whose land is recovered is compensated in land or housing but needs to be compensated in cash, he/she will be compensated in cash according to the wishes registered when making the compensation, support and resettlement plan.
For those whose land is recovered, if there is a need and the locality has conditions for land funds and housing funds, compensation will be considered for land compensation other than the purpose of use for the type of recovered land or housing.
In addition, according to Decree 151, the authority of the District People's Committee according to the provisions of the Land Law shall be transferred to the Chairman of the Commune People's Committee, including the recording of land prices in the decision on land allocation, land lease, permission to change land use purposes, extend land use, adjust the land use term, change the form of land use under the authority of the Chairman of the Commune People's Committee in cases of applying land prices in the land price list to calculate land use fees and land rents; issuing a decision on land prices under the authority of the Chairman of the Commune People's Committee for cases of determining specific land prices as prescribed in Clause 4, Article 155 of the Land Law.
Decree 151 also stipulates that the Chairman of the People's Committee at the commune level is decided to establish a specific land price appraisal council at the commune level.
