The Government has just issued Decree 151/2025/ND-CP regulating the division of authority of local authorities at 2 levels, decentralization of authority, and delegation of authority in the land sector.
Accordingly, Clause 2, Article 20 of Decree 151/2025/ND-CP stipulates the content of the commune-level land use plan from July 1, 2025, including:
- The area of land types that have been allocated in provincial land use planning, provincial land use planning, commune-level land use planning and the area of land types according to the land use needs of the commune level in the planning period and allocated to each planning year;
- List of works and projects expected to be implemented during the planning period; projects to arrange residential land and production land for ethnic minorities (if any); land area for auctioning land use rights, resettlement arrangement area, production land area expected to compensate people whose land is recovered;
- The area of land types, the list of works and projects that have been determined in the previous planning period and the area of land types according to works and projects as prescribed in Clause 4, Article 67 of the Land Law will continue to be implemented in the next planning period;
- Determine the area to change land use purpose according to the provisions of Clause 1, Article 121 of the Land Law, except for the case specified in Clause 5, Article 116 of the Land Law;
- Determine the area to be recovered for land as prescribed in Articles 78 and 79 of the Land Law during the planning period;
- Determine solutions to organize the implementation of land use plans.
In addition, Clause 5, Article 20 of Decree 151/2025/ND-CP also stipulates the establishment of a commune-level land use plan map as follows:
- Commune-level land use planning maps for areas with works and projects included in the list of land acquisition and conversion of land use purposes shall appear on the basis of commune-level land use planning maps or general planning maps or zoning planning maps approved in accordance with the provisions of law on urban and rural planning;
- Map or drawing showing location, boundary, area, and type of land for works and projects specified in Point a of this Clause on the cadastral map. In case there is no cadastral map, it will be used on the basis of the current status map of commune-level land use.
The People's Committee at the commune level is responsible for publicly announcing the commune-level land use plan at the agency's headquarters and on the electronic information portal of the People's Committee at the commune level. The term of the commune-level land use plan is 5 years.
