On the afternoon of January 6, at the regular press conference of Khanh Hoa province, Mr. Vu Chi Hieu - Director of the Department of Natural Resources and Environment informed the press about 2 cases of businesses suing local administrative decisions.
Previously, in December 2024, Khanh Hoa Provincial People's Court decided to apply emergency measures, temporarily suspending the implementation of 2 decisions on approving specific land prices to calculate land use fees at 2 projects in Nha Trang City.
These two projects are both located in Nha Trang City, namely Napoleon Castle I Apartment Project at 25-26 Nguyen Dinh Chieu of Cat Tiger Khareal Company Limited and Le Hong Phong 2 Urban Area Project of Ha Quang Real Estate Joint Stock Company.
The two above mentioned companies are the plaintiffs, suing the People's Committee of Khanh Hoa province in the administrative case of "Complaints about administrative decisions on land use". The defendants are the People's Committee of Khanh Hoa province and the Tax Department of Khanh Hoa province.
According to Director of the Department of Natural Resources and Environment Vu Chi Hieu, the People's Committee of Khanh Hoa province previously issued a decision approving specific land prices to collect land use fees for these two projects; collecting additional land use fees due to additional land allocation and adjusting detailed construction planning.
Mr. Vu Chi Hieu confirmed that Khanh Hoa Provincial People's Court has accepted and processed the files of these two administrative lawsuits.
The Department of Natural Resources and Environment has advised the People's Committee of Khanh Hoa province on the contents to be sent to the court. In the content sent to the court, the locality reported the entire process of land price construction, the process of the provincial land price appraisal council; the process of issuing decisions and has sent them to the court.
Regarding the above two administrative lawsuits, Mr. Nguyen Thanh Ha - Chief of Office and Spokesperson of Khanh Hoa Provincial People's Committee stated his opinion: Regarding the two enterprises suing administrative decisions, the sectors have also advised Khanh Hoa Provincial People's Committee in the direction that the locality has implemented in accordance with regulations.
If the business finds it unreasonable, it can file a lawsuit in court.
"This is a court decision. The spirit of the court is that whether the side is right or wrong, we must comply with the court's decision" - Mr. Nguyen Thanh Ha said and admitted that currently, land valuation in the area is very difficult.
Very few consulting units agreed to work. Meanwhile, there are some areas (projects) that have existed for a long time, so the determination of land prices and methods for determining land prices are not unified. Therefore, Mr. Nguyen Thanh Ha hopes that businesses will share with the locality.
