Citizens should send a question to the Ministry of Agriculture and Environment asking which agency confirms the origin of land use? Which agency is competent in confirming eligibility for granting a Land Use Rights Certificate?
Responding to this content, the Ministry of Agriculture and Environment said that, based on the provisions of Clause 4, Article 18 of Decree No. 151/2025/ND-CP, the People's Committees at the commune level, when carrying out procedures for granting Certificates of land use rights and ownership of assets attached to land (Certificate) in Articles 137, 138, 139 and 140 of the Land Law, do not have to alone confirm the compliance with the planning, do not dispute, and land is used stably.
According to Point a, Clause 3, Section II, Part C, Appendix I of Decree No. 151/2025/ND-CP, the People's Committees at the commune level shall organize the implementation of tasks according to regulations when granting the Certificate, including determining the origin of land use (in case the land plot does not have documents on land use rights), the specific agency shall be responsible for reviewing and determining the origin of land use assigned by the People's Committees at the commune level. The above regulation does not require confirmation of eligibility or inactivity for a Certificate.
